A nine-year-old American boy and his mother sue Nintendo.

They are claiming more than five million dollars in damages, criticizing the Japanese company for its lack of responsiveness to a malfunction of the Switch's control stick.

Nicknamed “Joy-Con drift”, the bug has been known for several years now.

The controller control system perceives and reproduces movements that the player has never made.

Mother and son have therefore launched a collective action with the justice, reports

The American explains having noticed the problem in 2018 and bought a new model, also defective.

The complaint accuses Nintendo of "continuing to promote and sell products knowing full well that they have a defect without bringing up the bug with consumers in the marketing or promotion operations or on the packaging".

Nintendo had indeed recognized the existence of a malfunction in July 2019. The president of the company then apologized.

The company then began to take charge of and repair defective products free of charge.

The move didn't stop a dozen console users from launching a class action lawsuit this summer.

In France, the UFC-Que Choisir association has also recently filed a complaint against the video game publisher, accusing the firm of planned obsolescence.
