The former Minister of the Interior, Jorge Fernández Díaz, broke his silence in relation to the Kitchen operation on Friday by means of a brief presented before Judge

in which he appealed his summons as a defendant.

According to Fernández Díaz, the mobile messages provided by the former Secretary of State for the Interior,

, in which he attributes knowledge of the operation to spy on Bárcenas, "neither sent nor received them."

Therefore, he attributes the preconstitution of false evidence to whoever was his right hand.

"The court should have verified the authenticity and the reality of such messages, for example, by taking an expert testimony," he argues through his lawyer

The former Minister of the Interior adds that "such messages were deleted on his mobile phone by Martínez himself" after they were formalized "before a notary," as is clear from the report of the Public Prosecutor's Office, he adds.

Moreover, he adds that "it seems that they have not been recovered after the content of their mobile phone was dumped by the Judicial Police."

"Therefore, the only record of such messages is printed through the two mentioned notarial acts," continues the former high-ranking official of the PP.

"Regarding the content of the messages," Fernández Díaz abounds, "it is totally implausible and contradictory."

He maintains that "it is absurd to think that he was aware of the dumping of the devices of [Luis] Bárcenas and his wife and that he was the one who informed the Secretary of State for Security" and not the other way around.

It should be remembered that in these messages Fernández Díaz, supposedly, provides him with the identity of the driver of the former treasurer of the PP Luis Bárcenas to capture him as a confidant and informs him that his mobiles have been "successfully" overturned.

"There is no doubt that the text messages are perfectly manipulable and that the notaries did not verify nor could they technically verify the reality of the communications that were exhibited to them," asserts the former Minister of the Interior in the Government headed by Mariano Rajoy.

"Regarding the probative value of the notarial acts of presence, it is known that formalizing certain messages or even going to the notarial presence act does not in itself constitute undoubted proof of the reality of the communication", questions Fernández Díaz.

"In other words, the notary does not certify the authenticity, veracity or authorship of the document or support displayed or notarized," he concludes.
