• The decision: The judge releases Rodrigo Rato with telematic control

  • The sentence The Hearing acquits Rodrigo Rato and the other 33 defendants in the 'Bankia case'

  • The facts: the expenses of the 'black' cards of Bankia and Caja Madrid

The former vice president of the Government and former president of Bankia, Rodrigo Rato, left the Madrid prison of Soto del Real this Friday, where he was serving a sentence for the black card case since October 2018, after having obtained the third degree that allows you to get out of jail by telematic control.

The Penitentiary Surveillance Court of the National Court granted this semi-release regime this Thursday because Rato had served more than a quarter of his sentence of four and a half years since last December and this week he was acquitted for the listing of Bankia, another of their judicial fronts.

After that decision, the Treatment Board of the prison met to determine the way in which he enjoys that third degree and agree on a compliance center and execution plan, with which Rato was able to leave the center on the afternoon of this Friday.

The former managing director of the International Monetary Fund (IMF) publicly apologized for the

black cards

at the time of entering prison, on October 25, 2018, but always defended his innocence in the Bankia IPO on the grounds that the operation had the approval of all supervisors.

Arguments for the third degree

Once acquitted of the accusation in the

Bankia case

, magistrate

José Luis Castro

admitted the appeal that Rato filed in July against the denial of the third degree and justified having waited for the sentence to resolve it, taking into account that the Prosecutor's Office asked for him to eight and a half years' sentence for investor fraud and accounting falsehood.

The judge took into account, among other factors, to grant him the semi-freedom that he has already faced the pecuniary responsibility derived from his sentence to four and a half years in prison and takes into account that he asked for forgiveness voluntarily, publicly and notoriously before his entry into prison.

Among the positive factors for the granting of the third degree, the judge also included the fact that Rato has enjoyed exit permits without incidents and the low prognosis of recidivism of the prisoner.

In addition, his advanced age, 71, would allow him, if the legal requirements are met, to obtain probation for the cause of

black cards

, as well as for the coronary diseases that he suffers.
