The Abu Dhabi Court of First Instance obligated a woman to pay 307,157 dirhams for the rental value of a land that she refused to pay her rent for 11 years, and the owner of the land filed a lawsuit against the tenant, demanding that she pay 305,243 dirhams, the value of the rent of the land since 2009.

The owner of the land had filed a preliminary lawsuit before the College Civil Department, in which she demanded to compel the tenant to pay her an amount of 305 thousand 243 dirhams, and to oblige her to monitor her liabilities until the date of full payment, at 75 fils per square foot annually, in accordance with the regulatory decisions in this regard, and to oblige her to fees and expenses Noting that the land was leased to the defendant in 1996, and she paid the rent until 2009, then she refused to pay the rent.

The court ruled that it had no value jurisdiction to hear the case, and referred it to the competent partial civil department, and postponed the decision on the expenses.

After the referral, the owner of the land came with an agent on her behalf, and the tenant failed to attend, despite her announcement, and the court ruled to assign an accounting expert, and his report concluded that the plaintiff's entitlements to the defendant regarding the land from 2009 to 2020 amounted to 307,157 dirhams.

The owner of the land submitted a memorandum, in which she requested to oblige the tenant to pay her the amount concluded by the expert, and the new amount of 75 fils per square foot until the date of payment, and obligate her to pay the value-added tax of 5% from the effective date of Decree-Law No. 8 / 2017 regarding value-added tax.

Regarding the plaintiff’s request to oblige the tenant to pay her the new amount of 75 fils per square foot, the court affirmed in the ruling reasons that the plaintiff did not request the termination of the contract until she responded to this request, and on the plaintiff’s request for a value-added tax of 5%, it stated that the papers are free from the copy of the value-added bill And evidence of registration with the tax number, regarding the land subject of the lawsuit, and this request was rejected.

The court ruled to obligate the defendant to pay the plaintiff 307 thousand and 157 dirhams, and obligated the defendant to pay the fees and expenses of the case, and it rejected all other requests.
