• Catalonia: Key week for rental prices in Catalonia

The Parliament rejected the amendments to the entire rule of the PP and the PSC as well as the proposals of Cs.

The law establishes that no contract may exceed the price of the previous one and the Catalan administration will limit the amount to be put according to the area in which the property is located, both in homes that are already for rent and in those that do so for the first time .

The measure could affect some 5 million Catalans in municipalities with more than 20,000 inhabitants, according to the Tenants Union, who until the last moment pressured JxCat to accept an agreement.

And it is that in the plenary session of last July, the formation of Carles Puigdemont and Quim Torra distanced themselves from the agreement with their partners in the Government and the other two parliamentary groups that proposed the law.

considered several of the articles of the regulation unconstitutional

That is why there were doubts about whether it could move forward in this Wednesday's session of the Parliament and regarding its route from now on.

For the moment, the first stumbling block was overcome when JxCat reconsidered its position and decided to approve the text after introducing a couple of changes that the price limitation did not apply to small owners who had income below 2.5 times the Income Indicator of sufficiency (IRSC), about 2,000 euros including rent.

In addition, at the request of JxCat, the rehabilitation and improvement works of the houses are also incorporated that would allow to increase the rent in a weighted way

to the invested capital up to a maximum of 20% of the price

New construction is outside the law to encourage the construction of protected housing.

Despite the approval of the law, representatives of JxCat and ERC took their disagreement until the last moment.

The president of the Generalitat, Quim Torra, called for a "collective effort" to give the green light to the rule, although the president of the ERC parliamentary group, Sergi Sabrià, advised his partners in the Government that "putting life at the center is This. We don't want your legs to shake to protect the right to decent housing. "

The regulations on the limitation of rents, the first approved in a community, came from the Department of Justice, controlled by the Republicans, although from the Ministry of Territory and Sustainability, in the hands of JxCat, it was questioned.

"We cannot understand why the work of another department of this Government is slowing down. We cannot understand it in a social emergency like the one we are in," said Sabrià, who added that passing the law is a matter of "political courage."

Precisely, Torra also made his reproaches ugly to the Republicans and asked them not to be mistaken as an "adversary" since those who opposed were Cs, PSC and PP since they consider it "electoralist" and "unconstitutional".

Precisely the PP group assured that it will take the rule to the Constitutional Court since there are several precepts that violate the Statute and the Constitution by invasion of State powers.

If the government does so, the law would be automatically suspended.

For the moment, the new regulations on rentals also establish that action must be taken in areas where the price has risen above the average for Catalonia, tenants allocate more than 30% of their income to rent and that the price has risen

The law provides penalties of 3,000 to 90,000 euros in the most serious cases, such as hiding that they must comply with the precepts imposed by the Generalitat.

The Tenants Union remarked that in the last five years rents have risen 30 times more than salaries in Catalonia.

The real estate sector and some employers have already shown themselves against the new rental regulation law.

The Association of Rental Home Owners (Asval) recalled that the regulations "violate the Constitution, violate the right to private property and will promote the underground economy in the rental market in Catalonia."

He also stressed that "it would scare away the investment necessary to develop a professionalized sector in the absence of legal certainty."

Jointly with the Col·legi d'Administradors de Finques de Barcelona-Lleida, the Consell de Col·legis d'Agents de la Propietat Immobiliaria de Catalunya, the Associació d'Agents Inmobiliaris de Catalunya, the Associació de Promotors i Constructors d ' Edificis de Catalunya (APCE) and the Barcelona-Lleida Urban Property Chamber consider that the regulation will not improve the options of the most disadvantaged or vulnerable families to access rental housing.
