Quim Torra intends to throw the Generalitat back down the precipice of disobedience. A little over two weeks after the Supreme Court decided his disqualification in firm, the head of the Catalan Executive has publicly threatened not to comply with the sentence and has demanded that the pro-independence forces not invest any alternative candidate to replace him. This is how he plans to rebel against a judicial dismissal that he takes for granted.

I have disobeyed twice. I don't think this is the last time I will. The decision of a Spanish court does not mark the calendar for me, ”Torra said through the TV3 speaker, who has interviewed the president to open another uncertain Catalan political course.

"It would not be understood that a pro-independence party presented another candidate," he insisted, in a message addressed to both ERC and JxCat and Carles Puigdemont himself . The fugitive suspects that one of his deputies replaces Torra once he is disqualified, which would force the party chaired by Oriol Junqueras to position itself. If ERC refused to invest in the replacement of the current president of the Generalitat, JxCat would obtain more ammunition to brand it as an accomplice of the Spanish Justice and if it swallowed - something that seems practically impossible - Puigdemont would have a new vicar at its command and could extend the legislature while designing a candidacy capable of flipping the polls and tracing ERC. A possibility that Torra does not like either: "You don't necessarily have to exhaust the legislature."

While he threatens to disobey and asks for the collaboration of all separatism - also that of Puigdemont - to carry out his plan, Torra continues to refuse to announce the date of an election whose date he says he has "decided." For months, the head of the Catalan Executive has been seduced by the idea of ​​locking himself up in the Palau de la Generalitat once disqualified to imply that he is reluctant to abide by the sentence. A staging that could culminate in signing the electoral convocation decree after the High Court has issued his final disqualification, but before the confirmation of his sentence is notified and, therefore, is effective.

Date "decided", but hidden

54 days have to pass from the electoral call for the early elections to be held, which, if Torra executes that maneuver, would place them between November and December, depending on the day on which the Supreme Court ratifies the disqualification.

If Puigdemont ignored Torra and imposed trying to invest an alternative candidate, the elections could be delayed until February or March 2021.

With Torra evicted, it would be Vice President Pere Aragonès, of ERC, who would assume the position on an interim basis. It would start a period of 10 days to present a candidate to occupy the Presidency of the Generalitat in a stable way and anoint him in a Plenary of investiture.

Defeated that candidate due to the presumed lack of support - neither ERC nor the CUP would support him - a final two-month period would be opened, starting from the first investiture vote. If no candidate has been elected within that period, "the legislature is automatically dissolved and the acting president [in this case Vice President Pere Aragonès] calls elections immediately," says the Law on the Presidency of the Generalitat. The elections would be held between 40 and 60 days after the electoral call.
