The Abu Dhabi Court of First Instance ordered the director of a medical center to indemnify a doctor in the amount of 20 thousand dirhams, after he insulted him and described him as "an animal", as compensation for the moral and moral damage he suffered.
The details of the case relate to a doctor’s filing a lawsuit demanding that the director of a medical center pay 250,000 dirhams in compensation for the material, moral and moral damages he suffered, after he was exposed to an incident of public insult in a public place, following a dispute between them about the doctor’s entitlements, and the director instructed false phrases For consideration, the doctor called the animal, and accordingly a report was opened with the police, and a criminal case was filed regarding these facts.
The Abu Dhabi Court of First Instance, the Court of Appeal, and the Court of Cassation ruled that the director was convicted of the crime of insulting the doctor, and ruled that the accused be punished by a fine of 5,000 dirhams and obligated to pay the penal fees. .
The doctor demanded compensation in the amount of 250 thousand dirhams, while the deputy director submitted a reply memorandum, in which he argued that the element of harm and the relationship of causation were absent, and at its conclusion he requested the dismissal of the case, accompanied by a folder of documents, which included a copy of the email issued by the director to the doctor regarding compliance with the instructions of the medical center. Confirming that there is a legal dispute between the doctor and the medical center.
The court stated in the merits of its judgment that the director’s mistake was fixed as mentioned above, which caused harm to the doctor’s feelings, caused him distress and moral pain, and resulted in psychological and moral damage to the plaintiff, which makes the request for compensation for moral and moral damage was based on reality And the law, and is worthy of acceptance, and given the same type of cursing phrases, and the extent of psychological and moral harm that could result from them, and given the social status of the plaintiff and the defendant, the court appreciates the compensation that the doctor deserves for the moral and moral damage he suffered.
The court ruled to oblige the director to pay the doctor an amount of 20 thousand dirhams in compensation for the moral and moral damage he suffered, and to oblige him to pay fees and expenses, and to reject all other requests.
