A resident of Bugulma, accused of sexually assaulting a one and a half year old daughter, faces 14 years in a strict regime colony - this term was requested by the state prosecutor at a court session on August 12. This was reported to RT in the press service of the Tatarstan prosecutor's office.

As noted by the prosecutor, the investigation proved the guilt of the defendant in violent acts of a sexual nature (part 4 of article 132 of the Criminal Code of the Russian Federation).

Earlier, the Bugulma City Court had already found the defendant Sergei Kukushkin not guilty in this case - then the court did not find corpus delicti in his actions, considering that "he did not try to satisfy his sexual needs at the expense of his daughter."

The prosecutor's office appealed against this decision. After the acquittal was canceled, the process was restarted.

Prosecution considers direct intent to be proven

The incident occurred on October 27 last year when Kukushkin was looking after three children while his wife was at work. At about 23:00 he called his wife and said that the youngest daughter was bleeding, the girl was hospitalized with genital trauma. After checking, a criminal case was opened against Kukushkin. He himself did not admit his guilt and claimed that he accidentally injured his daughter during a diaper change.

During the investigation, the wife of the accused wrote a statement to bring him to criminal responsibility, but then at all court sessions Anna Kukushkina stated that she did not believe in her husband's guilt.

According to the prosecution, the results of the examination, the testimony of the person involved in the case and his wife prove that the man acted with direct intent, and the injuries recorded in the child cannot be caused by accident.

At the trial, the prosecutor's office requested that medical documents from the Leninogorsk Central Regional Hospital (CRH) be added to the case upon the arrival of the victim. In addition, the state prosecutor filed a petition for the interests of the girl to be represented by an employee of the guardianship and guardianship department of the Bugulma municipal district, and not by her mother. According to the prosecutor, Anna Kukushkina does not care about her daughter's interests. The court rejected both motions.

In turn, Kukushkin's lawyer Salavat Raupov, in an interview with RT, noted that his client's guilt had not been proven.

“An expert was again questioned in court, who could not unequivocally state that the injuries were inflicted on purpose,” he stressed.

"I wrote the statement under pressure"

Earlier, RT had at its disposal a protocol of doctors from the Children's Republican Clinical Hospital, who treated the injured girl on October 31 last year. Then doctors diagnosed an injury to the external genital organs, damage to the vestibule of the vagina - a rupture of the posterior commissure, as well as a hematoma in the area of ​​the right labia majora.

At the same time, the doctors noted that the hymen of the filmic nature was not broken and completely blocks the entrance to the vagina.

“The wound was sutured, two interrupted sutures were applied,” the document says.

At the request of RT, forensic expert Alexander Aulov analyzed the diagnosis and noted that "by the nature of the injuries, it is impossible to make an unambiguous conclusion about whether they were inflicted on purpose."

“As for the hematoma, the father could touch the child with his finger if he changed the diaper inaccurately. The gap could also be caused by accident, for example, if a man wiped a baby with a diaper. An inexperienced father could do it too hard, ”the expert explained. - The hymen is intact, that is, there was no penetration, the external genital organs were damaged. Not a single expert, relying on this conclusion of doctors, will be able to unequivocally say that the injuries were inflicted on the child on purpose ”.

During the second consideration of the case, the court also questioned witnesses - friends of the Kukkushkin family who were in their apartment that evening.

“Anya called me around 11:00 pm, said that the youngest daughter was bleeding from the crotch and asked me to go to her home,” a witness in the case told RT. - The door was opened by Sergei, he spoke with Anya on the phone. I examined the child, there was a small amount of blood on the diaper, the girl was no longer crying. Then Anya came and she and her husband decided to call an ambulance: Sergei called, and Anya spoke to the doctors. "

Anna Kukushkina herself said that she had applied for her husband at the request of law enforcement officers.

"An investigator came to me and said that Sergei would be jailed, but if I write a statement in which I indicate that the child has been slightly injured, then nothing will happen to her husband," she said in an interview with RT.

On August 12, the defendant's lawyer filed a motion to exclude this statement from the case file. He insists that it was written under pressure, which means that it cannot be considered legal.

On August 13, Sergei Kukushkin will deliver the final word, after which the court will decide on his guilt.
