The Constitutional Council on Friday censured most of the LREM law providing for "security measures" for terrorist detainees leaving prison, ruling that many of the provisions of the text "infringe" several fundamental freedoms.

In their decision, the Wise Men consider that these measures, which had to be pronounced according to the "particular dangerousness" of a prisoner at the end of his sentence, "infringe the freedom to come and go, the right to respect for private life and the right to lead a normal family life ".

This controversial bill was definitively adopted at the end of July by the National Assembly. Faced with the controversy, the Minister of Justice and former lawyer Eric Dupond-Moretti had defended a "solution of balance" and had assured not to have been taken "suddenly by a blinding frenzy of freedom".

The text should open up to the judicial authority the possibility of imposing for five or ten years on those convicted of terrorism, at the end of their sentence, the obligation to respond to the summons of the judge responsible for the enforcement of sentences, establish his residence in a specific place, prohibitions on entering into contact and appearing in certain places, and also the obligation of pointing as well as, subject to the consent of the person, the wearing of the electronic bracelet.

These measures were to be limited to people sentenced to heavy sentences, exceeding five years' imprisonment.

In its decision, the Constitutional Council detailed the measures it considers contrary to fundamental freedoms.

"This is the case in particular of the obligation to establish one's residence in a specific place, of the obligation to report periodically to the police services or to the gendarmerie units, up to three times a week, of the prohibition to engage in certain activities, the prohibition to enter into contact with certain people or to appear in certain places, categories of places or areas and the obligation to respect the conditions of health and social care , educational or psychological ", write the Sages, by censoring the essential of the law.

The only article of the bill not censored by the Council concerns a secondary provision, which concerns the socio-judicial follow-up of detainees released from prison.
