From January to June 2020, fishery law enforcement agencies at all levels in the key waters of the Yangtze River Basin successively carried out 29,900 law enforcement actions, dispatched 220,400 law enforcement personnel, investigated 10,300 violations of laws and regulations, and seized 12,200 people involved. The Ministry of Agriculture and Rural Affairs also announced 10 typical cases of illegal fishing in key waters of the Yangtze River Basin.

  Statistics show that since 2020, local fishery authorities at all levels and fishery law enforcement agencies in key waters of the Yangtze River Basin have severely cracked down on illegal fishing, and severely investigated and dealt with a number of violations of laws and regulations. According to incomplete statistics, from January to June 2020, fishery law enforcement agencies at all levels in the key waters of the Yangtze River Basin carried out 29,900 law enforcement actions, dispatched 220,400 law enforcement personnel, investigated 10,300 violations of laws and regulations, and seized 12,200 people involved. Person-times, 2,537 suspected criminal cases were transferred to judicial organs, 3509 persons involved were transferred, 200.82 tons of illegally caught fish were confiscated, 8,214 vessels involving fishing "three noes" were cleared and banned, and 231,500 pieces of illegal nets were removed (top).

  At the same time, the Ministry of Agriculture and Rural Affairs selected 10 typical cases of fishing violations investigated by fishery law enforcement agencies at all levels in the key waters of the Yangtze River Basin this year for notification:

1. The case of two persons including Tang Mouyuan, Yongzhou City, Hunan Province, using electric fishing methods to illegally fish and escape in a prohibited fishing area

  On July 12, the fishery law enforcement agency of Qiyang County, Yongzhou City, Hunan Province used methods such as stepping on points, squatting and unmanned aerial vehicle inspections, and seized Tang Mouyuan and Wang Moufang in the Qiyang Huangnitang section of the Xiangjiang River using electricity in prohibited fishing areas. Fishing boats were used for fishing. More than 10 kilograms of illegal catches were seized and released on site. At the same time, 2 electric fishing boats and 2 electric fishing equipment were seized. Tang Mouyuan and two others abandoned the boat and escaped. Because Tang Mouyuan and others were suspected of constituting the crime of illegal fishing of aquatic products, the fishery law enforcement agency transferred the relevant evidence and materials of the case to the public security organ. The Qiyang County Public Security Bureau arrested the suspects Tang Mouyuan and Wang Moufang on the same day, and the case is currently under further trial.

2. The illegal fishing, transportation, and sale of aquatic products by Liu, Gu and other groups in Jiangjin District, Chongqing

  On July 6, the Agricultural Comprehensive Administrative Law Enforcement Detachment of Jiangjin District, Chongqing City and the Chongqing Branch of the Yangtze River Shipping Public Security Bureau used a variety of detection methods to uncover the clear division of labor headed by Liu and Gu, which was entrenched in the Jiangjin waters of Chongqing. The illegal fishing gang in the "one-stop industrial chain" arrested 8 criminal suspects, seized a high-speed aluminum speedboat, and several other criminal tools. After investigation, Liu and Gu gangs specially built high-power speedboats to avoid the attack, and arranged special personnel to follow the trends of public security, fishery administration, and private fishery protection organizations. The case is currently under further investigation.

3. Case of illegal fishing, purchase and sale of wild aquatic products by Tang and other groups in Yibin City, Sichuan Province

  On June 29th, the Aquatic Fisheries Station of the Agriculture and Rural Bureau of Cuiping District, Yibin City, Sichuan Province handed the clues of Mr. Tang suspected of illegally operating wild fish to the Public Security Bureau of Cuiping District. The public security department further investigated, analyzed, judged and obtained evidence Later, on July 2nd, Tang and his employees Wei and Wu were captured on the spot at Tang's store. At the same time, more than 10 kilograms of wild fish such as yellow catfish were seized on the spot. After the fishery law enforcement agency further fixed the evidence and confirmed the fishing gear, the public security department successively arrested more than 40 criminals suspected of fishing, purchasing, and selling wild fish, including Zhao, Huang, and Luo. Preliminary investigation results show that Tang's transaction amount for purchasing and selling wild fish has reached more than 8.6 million yuan, and illegally made more than 1.2 million yuan. At present, 43 people have been involved in this case, including 16 under criminal detention and 27 on bail pending trial. The case is under further investigation.

4. Two persons including Yang Mouxiang in Zhaotong City, Yunnan Province used electric fishing methods to illegally fish during the closed fishing period

  On May 8, river rangers from Potou Township, Zhenxiong County, Zhaotong City, Yunnan Province, and river rangers from Longdong Village, Shuitian Township, Weixin County, seized Yang at the site of Panjiujing and Jiming River Section in Baola Village, Potou Town, Zhenxiong County. Two people such as Mouxiang and Zhang used electric fishing methods to illegally fish. After siege, a set of electric fishing equipment, a rubber boat and several catches were confiscated on site. After the patrolman reported the case to the local rare fish management and protection station, the latter reported the case to the Agricultural Comprehensive Administrative Law Enforcement Brigade of the Zhenxiong County Agriculture and Rural Bureau. In accordance with the "Fisheries Law" and other laws and regulations, the law enforcement agency made an administrative penalty decision to fine Yang Mouxiang and Zhang 9,000 yuan, and confiscate the fishing tools. Because the parties involved used illegal operations to fish in the prohibited fishing areas and during the prohibited fishing period, they were suspected of constituting the crime of illegal fishing of aquatic products. The case has been transferred to the public security organ for further criminal investigation.

5. Case of two persons including Li Moubao in Ma'anshan City, Anhui Province using the "three noes" ship illegally fishing during the closed fishing period

  On May 4, the Agricultural Comprehensive Administrative Law Enforcement Detachment of Ma'anshan City, Anhui Province, seized two persons including Li Moubao, Han Mouchun and others driving a "three-no" steel vessel, which was used during the fishing period of the Xiaohuangzhou anchorage area in the Maanshan section of the Yangtze River Three-layer gillnet fishing, several catches were seized on the spot. In accordance with the "Fisheries Law" and other laws and regulations, the Ma'anshan City Agricultural Comprehensive Administrative Law Enforcement Detachment confiscated two "three-no" ships, two diesel engines, nets and other tools of crime against Li and Han, and fined them. An administrative penalty of 4,000 yuan was decided.

6. Case of illegal fishing using electric fish by four people including Yu Mouhui in Yueyang City, Hunan Province, driving a "three no" ship

  On April 23, in a joint law enforcement by the Fishery Administration Bureau of Yueyang County, Yueyang City, Hunan Province, and the Chenglingji Police Station of the Yueyang Branch of the Yangtze River Shipping Public Security Bureau, Yu Mouhui, Yu Moujun, and Zhou were seized in the waters of the Coal Bay of East Dongting Lake, Yueyang County. Four people including Hui, Peng and others used electro-fishing methods for illegal fishing, and seized 2 "three noes" ships and more than 260 kilograms of illegally caught fish on the spot. Yu Mouhui and others engaged in fishing using prohibited methods in the prohibited fishing zone, and were suspected of constituting the crime of illegal fishing of aquatic products. The Chenglingji Police Station of the Yueyang Branch of the Yangtze Shipping Public Security Bureau placed four people under criminal detention on the same day.

7. Case of 4 people including Liang Mouxi in Taizhou City, Jiangsu Province using electric fishing methods illegally fishing in prohibited fishing areas

  On April 5th, the Agricultural Comprehensive Law Enforcement Brigade of Gaogang District, Taizhou City, Jiangsu Province was conducting routine law enforcement inspections in the Yangtze River waters under its jurisdiction. It seized four people including Liang Mouxi, Shi Mouxin, Shi Moufei, and Shi Moujian using electric fish. Methods of illegal fishing, seized more than 10 kilograms of illegal catches such as crucian fish and bream, as well as criminal tools such as ships, batteries, electric fishing rods, and fishing nets used for illegal fishing. After investigation, since March this year, four people have implemented electric fish in the Yangtze River three times, and they have caught more than 30 kilograms of wild Yangtze fish such as bream, carp, and white silk fish. The case has been transferred to the public security organs for further investigation of criminal responsibility.

8. Case of illegal fishing by two people including Zhong Mou in Ganzhou City, Jiangxi Province using electric fish methods in prohibited fishing areas

  On April 5th, the Agricultural Comprehensive Administrative Law Enforcement Brigade of Shangyou County Agriculture and Rural Bureau, Ganzhou City, Jiangxi Province, after receiving reports from the masses, coordinated with the public security departments to carry out joint law enforcement, and seized Zhong Mou and Chen Mouwei in Shangyoujiang using electrofishing methods. Illegal fishing was carried out, and 4.3 kilograms of illegal catches such as yellowtail carp and electric fishing equipment were seized on the spot. In accordance with the "Fisheries Law" and other laws and regulations, the Agricultural Comprehensive Administrative Law Enforcement Brigade of the Shangyou County Agriculture and Rural Bureau fined the parties Zhong and Chen respectively by fines of 5,000 yuan and ordered rectification. Zhong and others used forbidden tools and methods to catch aquatic products during the closed fishing period and in the restricted fishing zone. They are suspected of constituting the crime of illegal fishing of aquatic products. The public security organs will further pursue criminal responsibility for this case. On June 18, the People's Court of Shangyou County issued a judgment and sentenced the defendants Zhong Mou and Chen Mouwei to a fine of 10,000 yuan, and confiscated the tools of the crime (the catch was treated by the public security organs for harmless treatment).

9. The case of Chen Mou illegally fishing eel fry in the waters of the Yangtze River estuary in Shanghai

  On March 31, law enforcement officers of the Shanghai Pudong New Area Agriculture and Rural Committee were patrolling the Yangtze River estuary for law enforcement and found that the person involved, Chen, had illegally caught eel seedlings in the Jiuduansha Wetland Nature Reserve in the Jiuduansha Wetland Nature Reserve and seized them on the spot. There are 6 nets and 58 eel seedlings. After retrospective analysis, Chen confessed that he had sold more than 10,000 eel seedlings and received more than 100,000 yuan in income this year. He had been punished by administrative punishment on March 9 for fishing in violation of the fishing license on the operating site. Chen was involved in the illegal fishing of aquatic animals without authorization in the restricted fishing zone and during the closed fishing period. He was suspected of constituting the crime of illegal fishing of aquatic products. The case has been transferred to the Shanghai Branch of the Yangtze River Shipping Public Security Bureau for criminal responsibility.

10. Case of 4 people including Wang Mouyin in Wuhan City, Hubei Province illegal fishing during the closed fishing season

  On March 18, in the waters of Longkou Gate, Xinzhou District, Wuhan Section of the Yangtze River, Wuhan Fishery Administration, Ship Inspection and Port Supervision and Administration Office of Hubei Province, four people including Wang Mouyin, Xiao Mouxin, Ji Moufa, and Xiao Mouyun were seized on the spot to drive a steel motor boat Gillnets were used for illegal fishing, and 1 steel fishing boat, 3 gillnets and 5 kilograms of catch were seized on the spot. In accordance with the "Fisheries Law" and other laws and regulations, the Wuhan Municipal Fishery Administration, Ship Inspection and Harbor Supervision Administration imposed a fine of 1,000 yuan for Wang Mouyin and Xiao Mouxin, and a fine of 500 yuan for Ji Moufa and Xiao Mouyun, and confiscated the fish.
