<Anchor> As the

National Assembly has come up with a number of measures over the so-called lease 3 law, we have obtained a government proposal with specific application policies. Even if the landlord raised the rent by more than 5% before the law was enforced, it contains information that allows the tenant to lower it back to within 5% if desired, after the law was enforced.

According to a joint review by the Ministry of Government on the'Lease 3 Act' obtained by SBS, when the landlord requested before the'Lease 3 Act' was implemented, and the contract was renewed earlier than the expiration date, for example, 10% of the rent After the law was enforced, if the tenant exercised the right to apply for a contract, up to 5% of the rent was left and the rest could be returned.

If the 10% increase is 10 million won, you can get 5 million won back.

The contract has not expired, but it is aimed at landlords who want to raise their rent significantly before the law is enforced.

However, it is also possible for the tenant to keep the renewal contract and exercise the right to request renewal when the contract expires.

What if the landlord contracts with a third party instead of renewing the contract with the existing tenant before the law goes into effect?

It is the government's position to admit such contracts with third parties.

That's why, if multiple contracts are entangled, invalidating a new contract will cause confusion.

The compensation system for the rights to apply for contract gangs is also being considered.

If the landlord says he will live, the tenant cannot exercise the right to renew the contract, but if the landlord does not live directly and lend it to someone else, the tenant will be compensated.

The government is responsible for reimbursing three months of rent or two years of the difference between new and existing rent.

The newly confirmed government proposal is expected to be more controversial in the legislative process of the National Assembly, as it has more unconstitutional fertilization that violates the property rights of landlords than the right to apply for a contract.
