It was in October last year that the then 15-year-old boy had sexual intercourse with a girl two years younger in her home. In June, the boy was sentenced to 70 hours of community service and SEK 25,000 in damages.

No abuse

The boy appealed the verdict to the Court of Appeal in Sundsvall, which now reduces the sentence to 40 hours of community service and also avoids paying any damages. But there was a disagreement between the Court of Appeal, the two judges in the Court of Appeal wanted to free the boy completely because the age between him and the girl was so small and that the circumstances surrounding the incident did not involve any abuse of the girl.

Sexual self-determination

It is with approximately the same motivation as the three legal judges who judge the boy have, but with the difference that they believe that the girl was relatively far from the age of sexual self-determination, which means that it is a matter of sexual exploitation.
