08 July 2020It is not illegal to expel Aspi from the reconstruction of the Morandi Bridge. This was established by the Constitutional Court, which considered that the issues relating to the legislative exclusion of Autostrade per l'Italia from the negotiated procedure aimed at choosing the companies to entrust the demolition and reconstruction works of the Morandi Bridge were unfounded. 

The Constitutional Court has examined in the today's council chamber the questions raised by the Tar of Liguria concerning numerous dispositions of the Law decree n. 109 of 2018 (so-called Genoa Decree) issued after the collapse of the Morandi Bridge. The decree entrusted the extraordinary demolition and reconstruction of the bridge as well as the expropriation of the areas necessary for this to an extraordinary commissioner. 

Furthermore, the commissioner was asked to identify the foster companies, precluding him from contacting the concessionaire Autostrade Spa (Aspi) and the companies controlled by it or associated with it. Finally, the contested decree forced Aspi to face the costs of the reconstruction and expropriations. 

The Court then declared inadmissible the questions on the similar exclusion of the companies connected to Aspi and those concerning the obligation of the concessionaire to meet the reconstruction costs of the bridge and the expropriation of the areas concerned.
The ruling will be filed in the coming weeks. 

Decision determined by exceptional gravity
"The decision of the Legislator not to entrust the reconstruction of the Bridge to Autostrade was determined by the exceptional gravity of the situation which prompted him, as a precaution, not to entrust the work to the company in charge of the maintenance of the Bridge itself" . The new bridge temporarily managed by Aspi 
However, on a temporary basis, the new bridge in Genoa will still be managed by Aspi. Infrastructure Minister Paola De Micheli announced it on Radio 24 Mattino. "I confirm that the new Ponte Morandi will be managed by Autostrade. I wrote the letter to Mayor Bucci. The management goes to the dealer, who is now Aspi, but there is still the possibility of revocation on the matter." 
"With Bucci - added De Micheli - we had a meeting a few days ago in which he asked what the routes were before the inauguration of the bridge and I confirmed the whole testing procedure, delivery and obviously that of post management - inauguration, which goes to the dealer. Obviously at this stage the dealer is Aspi and this affair is subject to a final stage, after this very tiring journey which has lasted nine months on the revocation and on the maintenance fulfillment affair ". "This - he concluded - is the option that I signed and sent to the Commissioner".

Autostrade's note: "For two years total support for the Genoa project"
"Autostrade per l'Italia, during these two years, has supported in any way the construction of the new viaduct on the Polcevera taking on all the demolition costs and construction. The total resources allocated to Genoa, in the form of compensation and support for citizens and businesses, are in excess of € 600 million ". This is what the company says in a release. Aspi - continues the note - has made a profound and radical change in its management and all its corporate processes. By 2023, the company will invest 2 billion euros in maintenance and maintenance costs for the network, of which 550 million euros in 2020 alone. To date, over 300 maintenance sites are active on the national network. Activities possible thanks to the 900 million euro loan made available by the Atlantia Group Leader, since Aspi last January, due to art. 35 of the Milleproroghe DL, has undergone a downgrade of its rating to the "garbage" level which has effectively blocked the company's access to credit ". 

Count: paradoxical situation. Dossier should be closed
