The judge of the ERE has reactivated the case for alleged crimes of trespass and embezzlement against the former president of the Junta de Andalucía Manuel Chaves and the former counselor of the Presidency Gaspar Zarrías for the "bridge" loan of 5,829,817 euros granted by the Government Andalusian PSOE to the meat company Hijos de Andrés Molina in 1999.

As reported on Tuesday by the Superior Court of Justice of Andalusia (TSJA), the reinforcing judge of the Court of Instruction 6 of Seville, which investigates the case of employment regulation files (ERE), has rejected the request for dismissal raised by Zarrías so that the magistrate shelved the case.

Through a 20-page car dated June 18, to which EL MUNDO has had access, Judge José Ignacio Vilaplana orders the practice of numerous proceedings to advance the investigations of a case that was opened in December 2019.

In it, ten former high-ranking officials of the Andalusian Government of the PSOE are accused - in addition to Chaves and Zarrías, there are former directors Antonio Fernández, José Antonio Viera, Guillermo Gutiérrez and Francisco Vallejo and former director general of Labor Javier Guerrero - and five directors of the company benefited by the irregular loan.

Condemnation of the ERE

The opening of this case occurred in the midst of a hangover from the judgment of the ERE of the Seville Court, which condemned Chaves and Zarrías in the so-called 'political piece', in addition to 17 other former senior officials of the Andalusian Government, for establishing a illegal procedure to distribute without control and for a decade almost 680 million euros in the form of socio-labor aid.

Judge Vilaplana has now ordered that different bodies of the Andalusian Government be freed to send them all the information about the 5.8 million "bridge" loan granted to Hijos de Andrés Molina (Hamsa) -then Campocarne and Primayor - by the old Institute of Promotion of Andalusia (IFA) and approved by virtue of an agreement of the Governing Council of the Board dated November 9, 1999.

The magistrate asks the Employment Ministry to send the "complete file" of the aid granted to Campocarne "as soon as possible", by virtue of a collaboration agreement signed on March 10, 2000 between the Ministry of Labor and Industry , represented by the counselor Guillermo Gutiérrez and the IFA, represented by its president Salvador Durbán .

Employment also requests that "at the earliest possible date" a "certified copy" of the "agreement or commitment" dated December 2, 1999, signed by Zarrías together with Miguel Ángel OB, president of Campocarne , "be sent under the which the Andalusian Government acquired the commitment to complete payment of the amounts that by job creation were stipulated until reaching the amount of 471,000,000 pesetas ".

Likewise, the judge of the ERE case requires various documentation related to the irregular loan to the Andalusian Chamber of Accounts , the General Audit of the Board and the IDEA Agency.

When he opened the case, the magistrate considered that the facts, which were denounced by the Anticorruption Prosecutor's Office , "could present characteristics that make it possible to presume the possible existence of a criminal offense", so "it is pertinent to open a new case that has for the purpose of determining and verifying the rational indications of criminality that emerge from the granting "of the credit of 5.8 million, which generated a hole of 3.7 million that the company never returned to the Board.
