In the Kirov region, a preliminary investigation has been completed on the high-profile criminal case of a “drunk” boy, who was shot down by a police officer to death. This was reported by RT representative of the family of the deceased child.

“We tried for a long time, and now, after almost a year, the driver was charged,” the lawyer said.

According to her, parents have already begun to get acquainted with the case materials. According to investigators, the culprit of the accident was Major Sergei Menshikov, the duty officer of the Nemsky police station, who was driving a car.

As RT previously told, a fatal accident occurred on July 13, 2019 in the village of Buiskoye. A six-year-old boy rode a bicycle from a dirt road to the main street, where he was knocked to death by a Nissan Qashqai, which, as it later turned out, was driven by Menshikov. According to eyewitnesses, the car was moving at high speed. The child received many injuries, from which he died on the spot. 

The tragedy received great public response after the publication by the child's parents of the results of the examination, according to which a six-year-old child was drunk at the time of the accident.

Expert Sergei Nasonov found 0.51 ppm of alcohol in the blood of a dead boy. Later, during interrogation, he admitted that alcohol could appear due to blood fermentation - there were no refrigerators in the local morgue and the child's body lay in the heat for several days.

In addition, as the investigation established, Nasonov did not conduct the examination on the day of the accident, July 13, but only on the 15th. In relation to Nasonov, a criminal case was initiated under Art. 293 of the Criminal Code of the Russian Federation “Negligence”. The investigation into the boy’s death was taken under control by the chairman of the RF IC Alexander Bastrykin.

Questions on the case.

At the same time, according to the representative of the boy’s family, all the time the preliminary investigation was going on, Menshikov was a witness in the case. 

According to a previous auto-technical examination, the Nissan driver was driving at a speed of 79 km / h, although the maximum permitted speed on this stretch of road was 60 km / h. At the same time, as RT reported, the expert considered that this factor did not cause an accident, indicating that Menshikov "did not have the technical ability to prevent collision with an allowed speed of 60 km / h."

However, the investigation nevertheless concluded that the driver could have avoided the accident. 

On May 29, 2020, Menshikov was charged under Part 3 of Art. 264 of the Criminal Code (Violation of traffic rules, resulting in the death of a person through negligence).

“We initially thought that he was driving about 90-95 km / h, but it turned out that his speed was 82 km / h and plus or minus 5 km / h. In addition, even at that speed he could avoid a collision! This has already been officially established by the investigation, ”says RT a representative of the family of the deceased child.

According to her, when familiarizing with the criminal case, some oddities were revealed. For example, in the case there are photographs of the boy’s car and bicycle, while it is stated that the pictures were taken on the day of the accident. But in fact they were made much later - during the investigative experiment.

“There is no hole in the photo that was on the day of the accident, and then it was closed up. Instead of the old rusty bicycle that the child had, a new bicycle. Although, on that old bicycle, the boy would hardly have accelerated to 16.9 km / h - according to the materials of the case, it was with this speed that the child moved. In addition, in the case there are photographs of his shoes - old heavy boots. A child shod in them would not be able to pedal quickly, ”says the lawyer. 

In addition, the injured party raises questions about the certificate of intoxication.

“In the documents on the study on alcohol there is no data on a detailed analysis, but it is only written that“ the state of intoxication has not been established. ” Menshikov did not undergo any examination for intoxication. Until mid-March, there were no documents in the case. We intend to prove that the driver was drunk, ”says an RT representative.

On this fact, the child’s father Vladimir Suvorov filed an application with the Prosecutor General’s Office, so that the supervisory authority checks the criminal case materials that raise questions.

RT tried to contact Menshikov, but he did not answer the calls. The Investigative Committee has not yet commented on the case file. 

Recall, this is not the only criminal case when, after a fatal accident, alcohol was found in the blood of a deceased child.

In 2017, in the Balashikha suburb near Moscow, Olga Alisova was shot down to death in the courtyard of the house of six-year-old Alyosha Shimko. 2.7 ppm of alcohol was found in the child’s blood. It turned out that forensic expert Mikhail Kleimenov, who conducted the examination, made a mistake. According to the sentence of the Shchelkovsky city court, the expert received 10 months of corrective labor, but because of the expired statute of limitations, he was completely released from punishment.

Olga Alisova in November 2017 was sentenced to three years in a penal colony. She was released in November 2019, after serving a full term.
