A great relief for some, a deep disappointment in others. This Wednesday, the Lyon Court of Appeal rejected the request for conditional release filed by the aggressor of Marin, this former student beaten in 2016 in Part-Dieu for defending a couple who kissed.

In May 2018, his attacker, a minor at the time and now 21, was sentenced to seven and a half years in prison by the juvenile assize court for having violently hit Marin with a crutch. Following this attack, the political science student, who later became a hero despite himself, was plunged into a coma for several weeks and today has serious consequences on the motor and cognitive levels.

A request accepted, the prosecution appeals

On April 29, the request to release his attacker, detained in Roanne prison (Loire), was accepted. But the Lyon public prosecutor's office appealed this decision, which was then misunderstood and denounced by Marin and his family. Contacted Wednesday by 20 Minutes, Audrey Sauvajon, Marin's mom, expressed deep relief at the announcement of the rejection of release.

“We have been suspended from this decision for the past few weeks. We are relieved to see that a judge, on reading the file, considered that the aggressor of Marin is not able today to reintegrate ", she underlined, judging the project of the young detainee "not completed" to ensure his exit. "We can not be made to believe that he is ready to reintegrate when he has multiplied the problems in detention," adds Audrey Sauvajon, reassured at the idea of ​​announcing the news to Marin. "He was very anxious about the fact that he was already out of prison, like our whole family," she explains.

"Premature" release

For Anne Guillemaut, the lawyer for the young aggressor, this decision is necessarily a disappointment. "I am not surprised but disappointed, reacts the lawyer present in Lyon during the rendering of the decision of the court of appeal. I have not yet received the decision but I was able to go through it at the hearing. The court considers overall that given the excitement of public order aroused by the request for release and the trauma still very significant of the victim, his release is premature, "said Me Guillemaut, who estimated the request of his client justified by his professional project.

To explain the continued detention, the Court of Appeal also considered that the voluntary compensation of the aggressor, who must pay the costs of the legal proceedings incurred by Marin's family, is not sufficient.

As for his behavior in detention, his lawyer tempered. "He was subject to several sanctions, it is true, mainly at the start of his detention. But there has been no disciplinary procedure against him for more than a year, "adds Anne Guillemaut, recalling that the sanctions of his client are linked to the detention of cell phones. Illegal but not very serious facts, according to the lawyer, convinced that her client was ready for the outing.
