Three years in prison suspended and five years of ineligibility were required Wednesday against the mayor of Sanary-sur-Mer (Var), Ferdinand Bernhard, for a series of economic and financial offenses testifying to a "misappropriation total ”of its function.

Fredinand Bernhard is criticized for the flash promotion of a lover as director general of services, at more than 5,000 euros per month, the use of free pass to build four villas on a plot of land he bought, the use improper use of a company car or the award of highly paid contracts, outside the procedure, to relatives.

100,000 euros fine

Mayor (various right) of this seaside town since 1989, re-elected in the first round in March, he mixed "his personal interests with those of the town", making "a system of operation," said prosecutor Etienne Perrin. Requesting his conviction for favoritism, illegal taking of interest or even misappropriation of public property, the magistrate also demanded a fine of 100,000 euros and the confiscation of the land concerned.

"It was a servant who served himself," added the representative of the public prosecutor: "the misuse of the function is such that [Mr. Bernhard] can no longer be lucid "on the" serious gravity of the facts ". The mayor "has been described as a king over his commune, with his qualities, concern for the general interest, attachment to economic development or children, but this is not contradictory with the arbitrary in his decisions" , he continued.

"He knows very well what he is doing"

The prosecutor mocked the posture of the mayor, presenting himself as an "ignorant, incompetent, and naive" while this retired dentist who continues to practice, president of community of communes and departmental advisor, earning 20,000 euros per month, is "A professional in public life, who knows very well what he is doing".

The prosecution requested, for concealment, six months suspended prison and deprivation of civil rights for two years against Jean-Jacques Ceris, that the mayor would have recruited in his office at 6,000 euros per month via a legal arrangement fraudulent, and of her ex-lover, Sybille Beaufils, bombed director of cabinet. Fines of 30,000 euros and 50,000 euros were required against them. Deliberation expected on September 7.
