The former UPyD leader, Rosa Díez, has addressed a letter to the State Attorney General's Office requesting that they investigate Pedro Sánchez, all his ministers, the director of the Center for Coordination of Health Alerts and Emergencies , Fernando Simón, and the Committee Technician who advises the Government to understand that they could have committed a crime of prevarication for not having forced the use of masks since the state of alarm was declared.

In a document presented to the Barcelona Provincial Prosecutor's Office , Díez denounces the Executive, and particularly the Minister of Health, Salvador Illa, also for having omitted to issue the alarm decree limiting more and longer the mobility of citizens until the Government could guarantee the supply of masks.

Díez supports his complaint in the fact that on May 20, a day after the mandatory use of masks was published in the BOE, Fernando Simón justified the decision saying that "in a situation of scarcity in the mask market We wanted to be very cautious when making recommendations that could not be applied, "thus acknowledging that they had not recommended their use before because they could not guarantee supply.

"The political criteria for protecting the image of the government were made to prevail," argues Díez, who considers that otherwise "a large number of infections and possibly also deaths would have been avoided." For all these reasons, the former leader of UPyD maintains that the accused "deceived" the population "in order not to harm their image."

The brief recalls that in a press conference held on February 25, Salvador Illa said that the use of masks was not necessary, and that four days later he insisted on this position in an interview in La Sexta, but that the criteria changed in April. , going so far as to say that its use was "very desirable" although "the compulsory issue" was another matter. On May 2, they were forced to use them on public transport and ten days later Fernando Simón assured that "the mandatory use of masks can cause problems." Finally, on May 20, the use of masks was imposed in all public spaces.

This sequence proves, according to Rosa Díez, that Pedro Sánchez and all his ministers, as well as Fernando Simón and the Committee of Technicians are responsible for an offense of omission of prevarication since "knowing that the use of masks should be mandatory, he deliberately hid himself ( ...) for not damaging the image of the Government to the detriment of the citizens who were lied to, thus exposing them to a greater risk of contagion ".
