• Justice: The judge sits the old police cupola on the bench for the Pujol pendrive against fiscal criteria

In the midst of a political revival of the patriotic police, this Tuesday begins the first trial against the activities of the agents at the Audiencia de Madrid, who are accused by the PSOE and, in particular, Podemos, of illegal activities in favor of political interests.

In the case of the purple formation , the accusation is not only rhetorical, but also legal: it is presented as a popular accusation in the trial that sits on the bench two leaders of the National Police for trying to introduce illegal data in the investigation of the Court National about the Pujol family .

The defendants are Eugenio Pino , deputy operational director (DAO) of the Police with the popular Jorge Fernández Díaz as interior minister, and his subordinate chief inspector Bonifacio Díez Sevillano . We can each claim a total of 10 and a half years in prison for the crimes of procedural fraud, false testimony, and discovery and disclosure of secrets.

The most direct victim , Jordi Pujol Ferrusola , is more modest and only asks for two and a half years in prison for a crime of revealing secrets. The Prosecutor's Office does not see a crime and requests acquittal.

Podemos will have a voice in the trial shortly after having suffered a setback in another of the cases against the patriotic police . The judge of the National Court Manuel García Castellón has withdrawn Pablo Iglesias the condition of injured in the case against the retired police commissioner José Manuel Villarejo for the theft of the mobile card of an adviser and the subsequent public dissemination of some messages. He did so after the latest measures placed him, rather than as a victim, as a suspect for not having acted correctly.

The 'Pujol case' and the 'pendrive'

In the case of the Pujol, the investigation has failed to determine who obtained the computer data from the computers of the first-born of the former president of the Generalitat of Catalonia. What the accusations do consider proven is that both Pino and Díez, "with knowledge of that illicit origin," maneuvered so that the information would be conveniently presented to Judge José de la Mata and could be used in the accusation.

The accounts of the accusations explain that, in March 2015, Díez gave the flash drive to the head of the Udef, the police unit specialized in economic crimes that investigated the Pujol. As he had agreed with Pino, Díez explained to the head of the unit that the "confidential information about the Pujol family" contained in the digital memory came from the judicial investigation opened in Barcelona with the Method 3 detective agency .

The Udef worked with these data and a year later, in April 2016, presented a report to the judge of the National Court. De la Mata was told that the information had been obtained through "police cooperation mechanisms."

That the police "connection of databases" had revealed that the 14th court in Barcelona had obtained relevant information by copying the computers of the detective agency.

The judge is suspicious

The judge was suspicious. He verified that nothing similar had come to the Barcelona court and expelled the material from the case to prevent it from contaminating the rest of the case and leading to nullity.

In addition, he denounced what happened in the ordinary courts in case there was a crime. The investigation that was opened is the one that led to Tuesday's trial.

The indictment presented by the lawyer Cristóbal Martell on behalf of Pujol Ferrusola indicates that what was obtained illegally was "the entirety of his computer life" for six years and that the information posted on a USB key contained "secrets, privacy data and Reserved personal and family data, from the consent to carry out a medical-surgical intervention, school work of their children Jordi and Merce Pujol Girones , or mountaineering excursions in Kenya, as well as business secrets and reserved data from legal persons ".

It highlights that the accused chief inspector had been stationed at the embassies of Andorra and Mexico, precisely, two key places in Pujol Ferrusola's business activity.

Villarejo, cited as a witness

The two defendants deny the facts. The defense document of the former DAO states that he was only informed of a pendrive , which was not the one that is now being brought to trial, which he never agreed to and that the former commissioner of Internal Affairs Marcelino Martín Blas spoke to, to whom he derived The responsability. This police officer has denied this in the investigation phase and is cited in the trial.

The list of witnesses proposed by the parties includes numerous police officers. Among them, the imprisoned Villarejo, quoted on Wednesday along with a dozen other witnesses. Pujol Ferrusola himself will be one of them.

On the first day of the oral hearing, Section 23 of the Hearing plans to question the two accused and seven witnesses. Thursday will be dedicated to the documentary evidence phase, in which the recorded conversations on this matter will be heard between Villarejo and Commissioner Enrique García Castaño , also on the unofficial list of the patriotic police .

The trial will conclude on Friday with the final requests of the parties and the interventions to argue them. Podemos will then have the opportunity to make a final report with its references - as far as the court allows - to the actions of the patriotic police .
