The head of the Central Court of Instruction number 6 of the National Court, Manuel García Castellón , has offered this Tuesday to Dina Bousselham , former adviser to Pablo Iglesias, to take advantage of the Statute of the Victim when verifying that she continues to share a lawyer with the Vice President of the Government.

The magistrate of the Villarejo case adopts this decision after Bousselham declared in court that Iglesias gave him the destroyed stolen mobile phone card and, days later, when the instructor and the Anticorruption Prosecutor's Office saw evidence of crime after the vice president's actions. of the Executive, radically change version.

As EL MUNDO reported, on May 28 Bousselham sent a letter to the Court, signed by her and her lawyer Marta Flor , where she changed the statement she made before García Castellón and the prosecutors to ensure that when Pablo Iglesias gave her the memory card "worked and checked that it contained the contents of his phone".

In an order, to which this newspaper has had access, the judge explains that "the attribution to Dina Bousselham of the condition of victim of the crime is evident from her first letter where she affirms that Law 4/2015 is applicable to her , of April 27, of the Statute of the victim of the crime ".

Likewise, the instructor explains that the victim's legal statute recognizes in article 11 a) "the right of participation of the active in the criminal process" and adds that "in the exercise of this right Dina Bousselham has been interested in the adoption of various summary investigation proceedings ".

"Will of the victim to clarify the facts"

"Article 11 b) of this same Law also recognizes the victim's right to appear before the authorities to provide them with sources of evidence. Thus, the briefs requesting investigative measures that have been presented to date and the last one contributing new manifestations, reveals unequivocally the will of the victim to clarify the facts that are the object of this procedure ".

The instructor adds that "this procedural position is evident at this time incompatible with that held by the same lawyer, by filing the appeal presented", representing Pablo Iglesias to request that his expulsion from the case be revoked as a private accusation.

"Thus things," says the judge, "given the writings signed by the same lawyer, and in order to safeguard and protect the victim of the crime investigated in this separate piece, Dina Bousselham, in the face of the conflict of interest found, agrees to transfer the Prosecutor's Office, the injured party itself and the parties to the case for a period of two hearings for allegations, "states the order.

Lawyer Flor filed an appeal on May 29 on behalf of Iglesias against the decision of Judge Manuel García Castellón to withdraw the status of injured party in Piece 10 of the Villarejo case . In it, the lawyer claimed to have "the conviction" that the theft of Bousselham's mobile "had no other purpose than to obtain sensitive information to harm Mr. Iglesias."
