01 June 2020 The Vatican's turning point on public contracts and contracts arrives in eighty-six articles. Pope Francis has launched "motu proprio" the rules "on the transparency, control and competition of public contracts of the Holy See and of the Vatican City State".

"The diligence of the good father of the family is a general principle and of utmost respect, on the basis of which all administrators are required to attend to their duties. This is explicitly required by canon law in relation to ecclesiastical goods, but it is generally valid for every other administrator ", explains the Pope.

"The world economy and an increased interdependence have brought to light the possibility of achieving significant economies of expenditure as an effect of the operation of multiple offerers of goods and services - continues Francesco -. These possibilities must be used above all in the management of public goods, where the need for a faithful and honest administration is even more felt and urgent, given that in this context the administrator is called to take responsibility for the interests of a community, which go well beyond those of an individual or belonging to particular interests " .

The new rules are "aimed at promoting transparency, control and competition in the procedures for the award of public contracts concluded on behalf of the Holy See and the Vatican City State - underlines Pope Francis -. With them I intend to establish general principles and outline a single procedure in this matter, through a normative corpus valid for the various Bodies of the Roman Curia, for the Institutions administratively connected to the Holy See, for the Governorate of the State, as well as for the other specifically identified public canonical juridical persons. even in its unity and homogeneity, this discipline contemplates those necessary differences between the Holy See and the Vatican City State well known in law and universally considered by legal practice, including international, as well as the specific purposes specific to each Body which, in reason of the only ecclesial service, it is called to apply it ".

According to the Pontiff, "the promotion of a concurrent and fair contribution of economic operators, combined with the transparency and control of contract award procedures, will allow for better management of the resources that the Holy See administers to achieve the ends that are proper to the Church , guaranteeing the same operators equal treatment and possibility of participation through a special Register of economic operators and specific procedures ".

"The operation of the entire system will also constitute an obstacle to restrictive agreements and will make it possible to reduce considerably the danger of corruption of those called to the responsibility of government and management of the entities of the Holy See and the Vatican City State - says Francesco - this procedural law is accompanied by a procedural law, aimed at guaranteeing the use of judicial protection in case of disputes regarding the procedures for the award of public contracts or in relation to registration or cancellation measures The specificity of the matter and the technicality of the substantive legislation justify the extension of the jurisdiction of the judicial bodies of the Vatican City State, to which is attributed the competence to know any disputes even if they concern Bodies of the Roman Curia, without prejudice to the jurisdiction of the Supreme Court of the Apostolic Signatura in case of conflict of attribution ".
