The judge investigating the authorization of marches such as the 8-M, Carmen Rodríguez Medel , has refused to charge Fernando Simón, director of the Center for Coordination and Health Emergencies. The magistrate rejects that possibility, not because she considers that there are no indications of a crime against him, but because there are already at least two courts in Madrid that have received complaints against the high position of the Ministry of Health.

Magistrate Carmen Rodríguez Medel has issued an order rejecting both this charge and that of all officials of the Madrid Government delegation, which had also been requested. In this case it specifies that "there are no indications that they have committed any of the crimes" attributed to them.

The two refusals of the judge to expand the number of defendants represent a response to the accusation that the State Attorney has made of launching a "general cause" against the Government for its action against the coronavirus. In its resolution, the judge insists on limiting its proceedings to the Government delegate in Madrid. "The only facts investigated in this procedure refer to the decisions made as a result of the health crisis derived from COVID-19 by the Delegate of the Government of Madrid, Mr. Franco Pardo, in relation to the concentrations and demonstrations that were communicated to him prior to the March 14, 2020 ".

Regarding the request to impute Simón, he replies: "Let the complainant know that this procedure is not directed against the aforementioned defendant and, on the contrary, a consultation in the computer application of these same Investigating Courts of Madrid shows that at least two Different courts have matters already registered in process against Mr. Simón, indiciary for the same crimes included in the expansion of the complaint before us, and must therefore present the expansion before said jurisdictional bodies and not before him. "

In the same resolution, the judge accepts the personation as a popular accusation of the Association of Consumers and Users José María Mena. Again limited to what affects the accused José Manuel Franco. The judge also seven witnesses to testify on June 11, the day after he appeared as a defendant of the Government delegate.

Two courts of instruction in Madrid, numbers 11 and 53, have two complaints against Simon on the table. One of them is the one presented by the Spanish Association of Victims and Victims by COVID-19 (ADAVIC-19), which attributes to the high position of Health the crimes of reckless homicide, injuries, prevarication and denial of help.

Another was brought by two family members of a woman who died of a coronavirus. In this reckless homicide, a crime against workers' rights and falsification of a public document. The latter for not offering the actual data on deaths from Covid-19. This letter blamed Simón for the deaths due to his "erroneous guidelines" and asked that he be prohibited from leaving Spain.
