The family of a deceased person with coronavirus has filed a complaint for reckless homicide, a crime against workers' rights and falsification of a public document against the director of the Center for Coordination of Health Alerts and Emergencies, Fernando Simón.

The brief blames him for the deaths from Covid-19 for his "wrong guidelines" on the pandemic. "We understand that most of the responsibility is due to the fact that the Government's expert adviser, the defendant, has been publicly communicating a series of erroneous and contradictory guidelines, making everyone believe that the impact of Covid-19 in our country would be minimum ", say the two relatives of MJGC , who died in Móstoles (Madrid) on March 19.

They add that these guidelines were "fatal, as they caused the guard to be lowered to such a degree that prevention means for hospitals were not collected and that the general population could not work and develop their daily lives with health guarantees ".

Other complaints against the Government

The complaint is in addition to others that have been filed, in particular or through associations, against Simón and other alleged perpetrators of the situation, including the Government.

In this case, to sustain the responsibility of the expert in Health Emergencies, the complaint is based on the criteria used by the Supreme Court in the Madrid Arena ruling, where there were convictions for reckless manslaughter.

The complaint recalls some of Simon's public statements, such as this one from January 31: "We believe that Spain will not have, at most, a diagnosed case. Hopefully there will be no local transmission. If there is, it will be a very limited transmission and very controlled. "

The document maintains that "the important thing is that the delay in warning the population of the true magnitude, when reports from other Administrations or the WHO, or the state of the situation in Italy [...] forced to extreme all caution and urgently collect individual and collective prevention materials. It is the theory that the Supreme Court uses in the Madrid Arena case and in all the judgments therein cited of the increased risk , which generates the criminal responsibility of the defendant. "

Without enough material

The accusation of having committed a "massive crime against the rights of workers" is based on the fact that their actions led to the fact that the various ministries did not "in time" provide themselves with individual and collective means of protection, "especially of officials and employees of the public sector".

And the imputation of documentary falsehood responds to the fact that Simón would have offered "false data" of those killed by Covid-19. "We point this out because the number of deceased, compared to what he stated, could be double or more," says the complaint, which includes the data on this line offered by the superior courts of Castilla-La Mancha and Castilla y León.

"Such falsehood would have prevented the population, especially in the earliest stages, from understanding the true magnitude of the pandemic in our country and, at least, from adopting measures of self-protection and social distancing," the complaint concludes.
