It was at 18.30 on September 24 last year that an employee of the psychiatry in Eksjö went and opened the door to the clinic when it rang. When he opened the door and asked the man at the age of 30 if he had not gone to the wrong department, he had to receive several punches in the face.

The care worker lost his balance and fell to the ground. Then the man at the age of 30 should have laid over him and put his arm around his neck so that he had difficulty breathing. However, he managed to press the alarm and a colleague came to the rescue and police were alerted to the scene.

Felt stress and anxiety

The man in his 30s has stated in interrogation that he had had a stressful night and that he had anxiety. He has, in interrogation, admitted that he has taken hold of the care worker so that he fell over, but does not admit that he has hit him in the face.

The prosecutor in his final plea for six months' imprisonment, but the district court makes a different assessment. It considers that the abuse did not last for a long time and that the injuries were of a transient nature and that the penalty value therefore corresponds to one month's imprisonment.

The abusive witness testified that he suffered a knee injury and that the inconvenience persisted for two weeks.

Serious mental disorder

According to the medical certificate, the offender must have suffered from a serious mental disorder at the time of the offense. Forensic psychiatric care without a special screening test usually entails a few months' stay in a psychiatric clinic. But since the man at the age of 30 has not been convicted of violent crime since 2011, the district court considers that conditional sentence with a fine is an appropriate sanction.

The penalty has been set at 30 daily fines of SEK 50.
