"I missed you as soon as I walked through the door ..." What value should be given to the words of a woman claiming to have been raped and who sends this message the next day to the one she accuses? Or this other one who will send dozens of sexually oriented texts? This is one of the main issues in the Tariq Ramadan investigation. The Muslim preacher was indicted for the rapes of four women, three others also claim to have been victims of him. After more than two years of investigation, the concept of moral restraint has gradually emerged as one of the keys to this complex dossier. The complainants claim to have been in the grip of Tariq Ramadan including after their attacks, the latter sees, on the contrary, in these exchanges the sign of a consensual relationship. It is to shed light on this dimension that the examining magistrates asked the psychiatrist Daniel Zagury, star expert of the courts, to determine the nature of the ties forged by Tariq Ramadan with the complainants.

"A mixture of extreme violence and lack of consideration"

For the psychiatrist, the grip is defined as a “set of mechanisms and processes which allow a psyche to exercise all power over another psyche, for its sole benefit, and without taking into account the own desire of the other. In his conclusions, consulted by 20 Minutes , he considers that this notion has indeed marked the relations of the Muslim preacher with two of the main complainants, Henda Ayari and a woman nicknamed Christelle, who claim to have been raped respectively in 2012 and 2009. According to him , the latter, guided by romantic feelings towards Tariq Ramadan, consented to a sexual relationship. What they were not, on the other hand, consenting to "was the acts she [s] described as a mixture of extreme violence and lack of consideration for her own desire and dignity" , he writes for both.

In the expert's view, the notion of control "essentially sheds light on the phase after the fact". Concerning Christelle, he specifies in particular that the complainant "experienced after the facts a feeling of guilt linked to the idea of ​​having disappointed him" before entering a "phase of spite and resentment, after a course of the meeting sexual activity marked by unwilling acts, reported as rape ”.

Mentioning a third complainant, Mounia Rabbouj, Daniel Zagury considers that "if the grip exerted by Tariq Ramadan sheds light on part of the relationship, it does not appear possible to consider that it is the only jurisdiction" . Thus, if the violence of Tariq Ramadan - who has not been indicted in this case - did not correspond "to his expectations of a woman in love", "the strength of his feelings" pushed him to lend himself to his requirements. For two other complainants, the expert dismisses the dimension of right-of-way. As for the last, she did not show up for the meeting.

In his eyes, the ties maintained by Tariq Ramadan after the facts were, for the preacher, a means “to erase the rape, to condition them” to accept what they had just experienced.

Conversely, the new counsel of the Muslim preacher, Mes Nabila Asmane and Ouadie Elhamamouchi, denounce a biased expertise in which their client was not heard. Nevertheless, according to them, the conclusions of Daniel Zagury are a disavowal for the complainants. "What should have been a lifeline actually turns out to be a burden for them since the expertise reaffirms the fact that they were willing to have sex with Tariq Ramadan. The lawyers, who last week took up the defense of the Muslim preacher, denounce a "trap" set for their client by the complainants.
