SVT Halland has previously reported that Falkenberg Municipality has chosen to deliberately violate the law by denying summer guests home service. The reason is that the municipality does not want to burden the home service staff further during the corona pandemic.
One person chose to appeal the municipality's decision and the Administrative Court has now annulled the decision.
- Falkenberg municipality's decision means that one decides not to fulfill the obligation that the municipality has under the Social Services Act. We at the Administrative Court have found that a municipality cannot choose whether to comply with applicable legislation or not, one must follow the law, says Karin Hartman, counsel at the Administrative Court in Gothenburg, to P4 Halland.
It is the social committee in Falkenberg that has decided to deny home service for visitors. SVT Halland is seeking the Chair of the Board Kerstin Rosell (S).
- We will check with SKR's lawyers and also with the municipal lawyer how we proceed in the matter, we have not decided whether we should appeal or whether we should settle in this instance, says Daniel Johansson head of social administration in Falkenbergs decision.
