  According to public information, Yang Wenping, male, Li nationality, was born in August 1963. He is from Baoting, Hainan, with a university degree. He joined the work in July 1984 and joined the Communist Party of China in June 1985.

  Yang Wenping served in the Sanya Youth League Committee, Sanya Environmental Resources Bureau, Hainan Provincial Political Consultative Conference in April 2011. He served as deputy secretary of the Lingshui County Committee of Hainan Province, deputy county head and deputy head of the county government (deputy department level) in April 2011. In January, he went to the office and became a member of the Hainan International Tourism Island Pilot Pilot Zone Working Committee and Deputy Director of the Management Committee.

Illegal land grant resulted in more than 200 illegal buildings

  The indictment disclosed that a Hainan company started to build 11 high-rise apartment-style residential buildings, 201 villas, 1 hotel, and the project supporting hardening on the 432.7 acres of land and other agricultural land illegally approved for acquisition since December 2016. Roads and other constructions (structures) have a total construction area of ​​63682.12m² and a total construction area of ​​429395.80m²; construction of temporary board houses covers an area of ​​14796.97m² and a total construction area of ​​21094.54m². The illegal buildings mentioned above have been investigated and dealt with according to law.

  In fact, just in December 2019 when Yang Wenping was double-opened, the conspicuous Lingshui illegal construction project "Guomao · Qingshuiwan" was also demolished according to law.

  According to the official website of Lingshui County Government, “Guomao · Clear Water Bay” was developed and constructed by Hainan Guomao Industrial Investment Co., Ltd. (referred to as “Guomao Company”). The project started construction without obtaining the right to use state-owned construction land according to law, planning permission, construction report construction and other relevant procedures and sold to the outside world in violation of regulations. The relevant departments of Lingshui County have completed the punishment for the land, planning and construction issues involved in the project.

  On December 14, 2019, the Lingshui County Comprehensive Administrative Law Enforcement Bureau coordinated relevant functional departments to demolish the illegal buildings of the project according to law, involving 201 low-rise villas, 2 high-rise residential buildings under construction and temporary work sheds, etc. Over 140,000 square meters.

  Earlier in April 2019, CCTV's "News Investigation" column once reported that the "Guomao · Clear Water Bay" project has 11 high-rise buildings, more than 200 villas, a mud therapy experience center and a five-star hotel.   In January 2019, Lingshui County took over the illegal buildings and structures of “Guomao · Qingshui Bay” according to law, and buyers were required to move out within a limited time.

  In an interview with CCTV, Liu Cheng, deputy secretary of the Political and Legal Committee of the Hainan Provincial Party Committee and leader of the Guomao Project Disposal Group, said that the government was indeed inadequate supervision and inaction in this incident, and even some public officials colluded with illegal enterprises.

  Zhou Shizhuang, deputy director of Lingshui County Public Security Bureau, also said that during the investigation of the case, Guomao Company was found to have paid bribes to relevant functional departments.

  In February 2020, the Second Branch of the People's Procuratorate of Hainan Province prosecuted Yang Wenping.

  The procuratorial organ believes that the defendant, Yang Wenping, as a state official, took advantage of his position to seek benefits for others and illegally received other people ’s property. The amount is particularly large, and he should be held criminally responsible for bribery.

  At the same time, the defendant Yang Wenping, as a staff member of the state organ, has committed malpractice for personal gains, violated land management regulations, abused his power, and illegally approved the acquisition of land, resulting in particularly significant losses to the state and collective interests. He should be held criminally responsible for the illegal approval of land acquisition .

  The procuratorial organ said that Yang Wenping confessed his crimes truthfully after arriving at the case, which was frank and could be punished lightly. It is recommended that he be sentenced to 12 years ’imprisonment and a fine of 2.5 million yuan for committing bribery; that he should be sentenced to 4 years’ imprisonment for the crime of illegally approving land expropriation; .
