Two years in prison and five years of socio-judicial monitoring and obligation to care. This is the sentence pronounced Friday evening by the Toulouse criminal court against Thierry Delay. Now 56, he was sentenced in 2004 to 20 years' imprisonment by the Pas-de-Calais assize court for raping four of his children and eight other children.

The one nicknamed "the monster of Outreau" was back on the bench Friday for a "sexual assault on a vulnerable person" and harassing acts towards a resident of the Pierre-Hanzel center in Rieux-Volvestre where he is hosted since May 2016 to treat her multiple sclerosis.

Multiple sclerosis

He is a diminished man, traveling in a wheelchair, and with speech difficulties who appeared in court on Friday. Despite a difficult expression, the accused partially acknowledged the facts, while minimizing them. Between 2016 and 2019, he touched the chest of another resident in a wheelchair and suffered from the same illness as him.

"I was in love with her and I told her about the pornographic videos that I watched," explained Thierry Delay. It was because of my libido problems. I wanted to touch her because her skin was soft. I don't understand why we talk about sexual assault when I just touched it ”. In June 2019, the accused received an injection to restrict his libido. "I had a resumption of my impulses so I asked for this treatment because I wanted to stop bothering this resident," he concedes.

His victim is still afraid of him

Although a complaint was filed against the former accused in the Outreau case, the victim was not present at the hearing Friday, however. "She said that she suffered too much from her harassment and that she is still very afraid of him," said the president of the criminal court.

For the prosecutor, Thierry Delay has remained a "predator" despite his long years in detention. "He was fully aware of the victim's lack of consent, but he was trading favors for cigarettes because she used a lot of tobacco," she said. And what is frightening in this case is to note that the socio-judicial monitoring put in place after his release from prison has been fully respected. Without achieving its goal ”.

Need for care

According to counsel for the accused, “there is no procrastination for sexual assault or harassment. I have the weakness to think that it can evolve and that locking it up is not a solution: the proof, it spent sixteen years in prison and that did not work. He can no longer walk and does not pose a threat to others. He needs care and to be accompanied ”.

The prosecutor had requested three years in prison, with a warrant, an obligation to care as part of a new socio-judicial follow-up of 5 years. Before the court withdrew to deliberate, the accused apologized for the harassment of this resident and asked for forgiveness.

Finally sentenced to two years in prison, Thierry Delay is also prohibited from entering into contact with his victim. His lawyer has already indicated that he will not appeal the decision.
