The PSOE registered in the Congress of Deputies in January a Proposal for a Law of Historical and Democratic Memory that, among other tasks, pursues, as explained by the Socialists "definitively banish from our society the Franco regime and all that it represented, as a stronger symbol of the denial of those values. " This text is the basis on which the Government works.

Thus, its work plan is to endorse this proposal of law despite the fact that it has not yet begun the parliamentary process and, therefore, it remains to be known the changes to which it will be submitted by the parliamentary groups. The Government wants to consider a very serious infraction "the lack of adoption of the necessary measures to prevent or put an end to the realization, in open spaces to the public, of acts of exaltation, exaltation or commemoration of the military coup of 1936, of violations of human rights committed during the Spanish Civil War, of the Franco dictatorship, or of the dictator Francisco Franco by the owner or head of the space where such acts take place. "

It appears in the text registered by the PSOE and has been confirmed by the Government itself in a parliamentary response to the deputy of EH Bildu Jon Iñarritu. "The Government has been working in this direction to typify as a very serious infraction the calls for this type of acts and punish those who are responsible for their call, organization and development with fines ranging from 10,001 to 100,000 euros."

The fine can also lead to other sanctions such as the temporary closure, for a period of six months and one day to two years, of the premises or public establishments "where acts of exaltation, exaltation or commemoration of the military coup of 1936 are carried out. , of the human rights violations committed during the Spanish Civil War, of the Franco dictatorship, or of the dictator Francisco Franco "or the" confiscation of the assets, means or instruments with which the infraction has been prepared or executed. "

In the response provided to Deputy Iñarritu, the Executive reaffirms its claim to end the Francisco Franco Foundation. "Possible regulatory modifications are studied aimed at regulating the suppression of legal persons that publicly incite, directly or indirectly, hatred or violence against the victims of the Spanish Civil War and Francoism as such."
