The Decision of the Standing Committee of the Hubei Provincial People's Congress on Severely Cracking down on the Trade in Illegal Wildlife, Comprehensively Banning Wild Animals, and Effectively Safeguarding the People's Health and Safety Adopted on March 5, 2020, it is now announced and will take effect from the date of announcement.

In order to severely crack down on illegal wildlife trade, comprehensively ban wildlife consumption, maintain biological and ecological safety, effectively prevent major public health risks, effectively protect the lives and health of the people, strengthen the construction of ecological civilization, and promote the harmonious coexistence of man and nature. The Law of the People's Republic of China on the Protection of Wild Animals, the Decision of the Standing Committee of the National People's Congress on Comprehensively Banning the Trading of Illegal Wildlife, Eliminating the Bad Habits of Wild Animals, and Effectively Safeguarding People's Livelihood, Health and Safety, etc. Decided as follows:
I. It is forbidden to consume the following wild animals and their products:
(1) All terrestrial wildlife, including terrestrial wildlife that are artificially bred and raised;
(2) precious and endangered aquatic wild animals that are specifically protected under laws and regulations;
(3) Other wild animals prohibited by law and regulations.
The wild animals and their products specified in this decision refer to the whole (including eggs and eggs), parts and derivatives of wild animals.
Animals included in the catalog of livestock and poultry genetic resources belong to domestic animals and poultry, and their breeding, quarantine, and food consumption shall be implemented in accordance with relevant laws and regulations.
2. No organization or individual may produce, process, or sell foods made from wild animals and their products that are forbidden to eat.
No organization or individual is allowed to hunt, breed, breed, trade, transport, carry, or deliver prohibited wild animals and their products for the purpose of eating or producing, processing, or selling food.
No organization or individual is allowed to publicize, solicit, induce or consume illegal wild animals and their products, or engage in illegal wildlife trading by publishing advertisements, making signboards or recipes.
In case of non-edible use of wild animals due to special circumstances such as scientific research, medicine, display, etc., strict examination and approval and quarantine inspection shall be implemented in accordance with relevant national and provincial regulations, and special marks shall be obtained and used in accordance with regulations to ensure traceability.
3. Online trading platforms, commodity trading markets, agricultural (market) markets, catering establishments, and other trading and consumption venues, as well as operators and media such as transportation, warehousing, and postal delivery, shall not be in violation of Article 1, paragraph 1, The conduct stipulated in Articles 2 to 3 of Article 2 provides conditions, venues, or services for transactions, consumption, and publicity.
4. The people's governments at or above the county level shall organize, guide, coordinate, and urge relevant departments to perform supervision and management duties in accordance with the law, improve the law enforcement management system, implement law enforcement management responsibilities, increase supervision and inspection and accountability, and strictly investigate and deal with violations of relevant laws and regulations and Deciding behavior.
The township people's governments and sub-district offices should do relevant work in accordance with the law.
5. The forestry, fishery, and market supervision and management departments of the people's governments at or above the county level are responsible for the supervision and management of the complete prohibition of edible wild animals in accordance with the division of responsibilities, and severely crack down on illegal wildlife trade in accordance with the law.
Public security, health, natural resources, ecological environment, agriculture and rural areas, commerce, online information, city management, transportation, postal management and other departments shall do relevant work in accordance with their respective duties.
6. Administrative law enforcement agencies and judicial organs at all levels shall improve the working mechanism of administrative law enforcement and criminal justice convergence, and severely crack down on illegal wildlife trade, destruction of wildlife resources and other related crimes in accordance with law.
7. State organs, people's organizations, social organizations, scientific research institutions, village (resident) committees, and the media should organize publicity and education on the comprehensive prohibition of wildlife consumption, ecological environmental protection, and public health and safety, and popularize scientific knowledge. jobs.
The administrative department of education shall organize the school to carry out education on scientific knowledge related to the comprehensive prohibition of wildlife consumption, ecological environmental protection and public health and safety.
The public should consciously enhance their awareness of ecological environmental protection and public health safety, abolish the bad habits of overeating wild animals, and develop a scientific, healthy, and civilized lifestyle.
Encourage and support volunteer organizations and volunteers to participate in the publicity, education and supervision of the complete prohibition of wild animals, ecological environment protection and public health safety.
8. Any organization or individual has the right to report any violation of relevant laws and regulations and this decision to relevant departments and agencies.
Relevant departments and agencies that accept reports shall promptly investigate and deal with them in accordance with the law and keep the information of the informants confidential; if the verification of the report is true, the informers shall be rewarded.
9. The Provincial People's Government and its relevant departments shall, in accordance with relevant laws and regulations and this decision, formulate and adjust relevant lists and supporting regulations in a timely manner.
People's governments at or above the county level shall take necessary measures to provide corresponding guarantees for the implementation of this decision; support, guide, and help affected farmers and operators to adjust and change their production and operation activities, and provide certain compensation according to the actual situation.
X. Administrative penalties shall be imposed for violations of this decision in accordance with relevant laws and regulations; if a crime is constituted, criminal liability shall be investigated in accordance with the law.
If administrative penalties are violated for violation of this decision, relevant government departments shall incorporate the illegal information into the social credit information service platform in accordance with regulations and implement joint punishment in accordance with the law.
Eleventh, state agencies and their staff who severely crack down on illegal wildlife trade, comprehensively prohibit the consumption of wild animals, abuse their powers, neglect their duties, and engage in malpractices for personal gains shall be ordered by their competent authorities or supervisory authorities to make corrections. Personnel and other persons directly responsible shall be punished according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.
12. This decision shall be implemented as of the date of promulgation.
