China's Ministry of Justice publicly solicits opinions on regulations governing foreigners' permanent residence: foreigners who have achieved outstanding achievements can directly apply for permanent residency

China News Service, Beijing, February 27th (Reporter Zhang Ziyang) The Ministry of Justice of the People's Republic of China issued the "Regulations on the Management of Permanent Residence of Foreigners in the People's Republic of China (Draft for Solicitation of Comments)" on 27 March 2020.

The Consultation Draft states that in order to further open up to the outside world, standardize the management of foreigners' permanent residence in China, and protect the legitimate rights and interests of foreigners who have obtained permanent residence status, these regulations were formulated in accordance with the "People's Republic of China Exit and Entry Management Law".

The ED draft clearly states that the permanent residence permit of a foreigner is proof of the identity of the foreigner of permanent residence in China. A foreigner who is permanently resident may engage in related activities based on his or her identity certificate, and the relevant unit and its staff shall not refuse.

The consultation draft lists several situations in which foreigners can apply for permanent residency in China.

For example, foreigners who have achieved internationally recognized outstanding achievements in the fields of economy, science and technology, education, culture, health, sports, etc., can directly apply for permanent residence status. Foreigners who have made outstanding contributions to China's economic and social development can apply for permanent residency upon the recommendation of relevant national authorities or the people's governments of provinces, autonomous regions and municipalities. Foreigners who need to be introduced due to the country's economic and social development, such as urgently needed talents introduced by the state's key industries, regions, and recommended by the competent department, can apply for permanent residency.

The consultation draft stipulates that foreigners applying for permanent residency should submit an application to the entry-exit administration of the public security agency in the place of residence, truthfully report the application information, submit their passport or other international travel documents, photos and application materials that meet the requirements, and accept them in accordance with regulations. Interview, and keep personal identification information such as fingerprints. The permanent residence of a foreigner in China must not be less than three months per year.

The consultation draft requires that the relevant departments of the State Council and local people's governments at all levels should gradually promote the socialization of permanent residence ID cards in accordance with the actual conditions of their own departments and regions, and apply for permanent residence aliens in China with foreigners' permanent residence ID cards. Finance, foreign exchange, education, medical treatment, transportation, telecommunications, social insurance, accommodation registration, property registration, motor vehicle driver's license application and other matters are provided to facilitate.

According to the Draft for Comment, foreigners of permanent residence may pass through the special passages for Chinese citizens when they enter or leave the country. Foreigners of permanent residence may purchase self-use and self-occupation commodity housing in China in accordance with relevant regulations, and may deposit and use housing provident funds in accordance with relevant provisions of the housing provident fund management. Foreigners of appropriate age who are permanent residents or children who have moved with them may receive compulsory education in China without any fees other than those stipulated by the state.
