February 21, 2020 "Finally, Rai was able to read the reasons that led Agcom to impose a penalty of 1.5 million for alleged violation of the rules on information pluralism. In particular, the Authority, neglecting to consider the thousands of hours of plural, accurate and in-depth information that is guaranteed annually and always by the dealership at national and local level, focuses on single episodes that cannot be compared with each other. Some date back in time and have never been contested before, yet are approached in a way arbitrary and confused in terms of both content and chronology. All to reach conclusions of a substantially deontological and editorial nature regarding the modalities of exercise of the constitutionally guaranteed right of free expression of thought, criticism and news of Rai journalists, for whom even the adoption of training initiatives is requested ".

Thus, in a note, Rai stated that "Agcom's decision on the determination of the sales prices of advertising spaces is also completely incomprehensible, taken with a second resolution which apodictically reaches the conclusion that Rai would have adopted, in a market which, moreover, Agcom expressly considers as a whole opaque, a commercial policy that is not transparent ".

"And this without even a prior and thorough market investigation involving all operators in the audiovisual media sector or the support of exhaustive and explanatory mathematical elaborations, or the reference to a single numerical value. The company - concludes the note - considers the Authority's findings completely unfounded and seriously detrimental to its editorial and corporate freedom, and is consequently evaluating all the appropriate initiatives to be taken ".
