Already three years ago, the midwife was investigated by the Inspection for Health and Care (IVO). There she received criticism for her professional practice after giving a mother too much pain stimulant.

Concern from the trade union

The health care association is critical to individual employees being prosecuted for errors in care. Rarely is this type of event judicially tried.

- The usual thing is that the IVO examines and that it is tried by the Healthcare Responsibility Committee, which can hand out disciplinary measures. For example, they can withdraw a nurse's credentials. I can feel worried that it may go too far if the staff is charged with mistakes in care, says Malin Tillgren, chairman of the Skåne health care association.

Sufficient evidence

The Nursing Association was involved in supporting the current midwife when the nursing loss was reported to IVO. However, they did not participate in the police investigation.

According to the prosecutor, sufficient evidence has emerged during the police investigation to prove that the midwife's actions can be criminal.

- I have made an overall assessment after talking to the staff and receiving the opinion of experts. Based on that information, I have prosecuted. If it had been intentional, it would have been abuse, but I have no grounds for it. I can only prosecute if it can lead to conviction on independent grounds, says prosecutor Elena Severin.
