The rise above the limit set by the General State Budgets to the workers of the Madrid City Council during the Government of Manuela Carmena has met with the Madrid Justice. The Superior Court of Justice of Madrid ( TSJM ), in a judgment advanced by ABC and to which EL MUNDO has had access, has annulled the economic agreement reached by the former mayor with the unions "for not complying with the law."

The Madrid court thus considers the appeal that the State Advocacy filed, as a representation of the Government Delegation in Madrid , against the agreement adopted on September 14, 2017 by the Municipal Government Board in which a rise was established for public officials in the capital above the limit set in the general accounts of the State, approved at that time with the PP in the Central Executive.

This agreement signed by the former mayor with the unions Comisiones Obreras, UGT, CSIF and CSIT on June 28, 2017 was intended to match the working conditions of the 4,200 members of the labor staff - workers of sports facilities, Madrid-Health , City Council Informatics of Madrid (IAM), Employment Agency, Tax Agency, Activities Agency and the Consistory itself- with those of the official staff. According to the Consistory itself during the Now Madrid stage, this measure meant an additional 9.5 million euros of expenditure for municipal coffers.

The ruling of the TSJM argues that in the municipal budgets of the city of Madrid for the year 2017 "the 1% remuneration increase is already foreseen" and, therefore, "any forecast of additional increase" for municipal corporation officials "Must be annulled" since "it violates the precepts and norms transcribed, since it exceeds the 1 percent remuneration increase established for the 2017 General State Budget ".

The Justice understands that “the total estimation of the appeal” presented by the State Advocacy is appropriate because “the right to collective bargaining or freedom of association” is not violated because when the previous municipal government signed the agreement “there was no possibility of such salary increases above 1 percent »because« the freedom of pacts of Local Corporations is subject to the basic State Legislation ».

And, given this basic state legislation, the Justice points out that it is "rules with a uniform application throughout the national territory", so that, in accordance with the Budget Act for 2017, the ruling establishes that « the remuneration of personnel in the service of the public sector may not experience a global increase of more than 1% compared to those in force as of December 31, 2016 ».

The TSJM also imposes costs of 5,000 euros to the municipal corporation, which, not being before a final sentence, has a legal period of 30 days to file an appeal to the Supreme Court.

Sources from the current government team headed by José Luis Martínez-Almeida point out that "there has been a first meeting with social agents" and that they will begin to "study carefully and in a responsible manner with legal services the decisions to be taken."

The Consistory notes that "those affected by that decision" are the 4,000 members of the workforce - "not all the staff", they add - that "now they may have to face the refund of the amounts . "
