The State Duma adopted a law on the right of children to housing when parents divorce

The State Duma in the third and final reading adopted a bill that will allow the courts to attract a parent who lives separately from the child after the divorce to pay the cost of providing him with suitable housing.



The corresponding document is published in the electronic database of the State Duma.

As noted in the explanatory note, according to Article 86 of the Family Code, these additional expenses are paid in excess of alimony in case of treatment and rehabilitation of the child, however, the new bill clarifies the list of exceptional circumstances and introduces a clause on it “lack of suitable living quarters”.

“The change envisaged by the bill in conjunction with the current legal regulation of children's housing rights will allow the court in each case to assess the situation taking into account all the circumstances and make a decision based on the balance of interests of the child and the parent paying alimony,” the document says.

In November, it was reported that Russians older than 23 years old, included in the list of orphans and legally entitled to receive housing from the state, will be offered to choose between a finished apartment and a certificate for self-purchase.
