  • Alexandre Benalla has been indicted for a dozen crimes since he molested a couple of demonstrators on May 1, 2018 in Paris.
  • A year ago, Mediapart revealed a series of seven compromising tapes for its defense.
  • According to our information, the former project manager went to court to have these recordings canceled. A hearing will take place on February 4.

On the tape, we can perfectly distinguish his playful tone. At the border of carelessness, unconsciousness and boasting. "It's a crazy thing (...) A good experience. If you want, at 26, there aren't many people who provoke two parliamentary commissions of inquiry! Alexandre Benalla no doubt regrets the remarks made on July 26, 2018 to his acolyte, Vincent Crase, and whose recordings have since been revealed by Mediapart and placed in the file.

According to our information, the former mission officer of the Élysée has seized the justice in order to cancel the procedure of these seven recordings which lead his defense. His request for a declaration of invalidity must be examined on February 4 at 11 a.m. by the investigating chamber of the Paris Court of Appeal, during a hearing in camera.

Former Chargé d'Affirms Fairness of Evidence

Nine months after the events of May 1, place de la Contrescarpe, during which Alexandre Benalla had molested demonstrators, Mediapart had unveiled a series of recordings putting two pennies back into the machine. We discovered there that the Élysée adviser boasted, in the days following the revelation of the facts of the Place de la Contrescarpe and the opening of an investigation, to always have the support of the “boss” Emmanuel Macron and "Madame" Brigitte Macron, that he was violating his judicial control prohibiting him from meeting Vincent Crase and, above all, that he was involved in the signing of a contract with a sulfurous Russian oligarch, Iskander Makhmudov.

So many potentially compromising elements that he now wishes to see disappear from the current procedure. For this, the former relative of the President of the Republic intends to invoke the fairness of the evidence, governed by article 427 of the Code of Criminal Procedure.

Mediapart having always refused to indicate the origin of the recordings due to the secrecy of the sources, Alexandre Benalla does not exclude having been trapped by the French intelligence services. In which case, the recording of his conversation with Vincent Crase should have been the subject of a prior declaration. This having not been done, the former project manager assures that the evidence is not "fair" and that she must therefore leave the file. As well as all the other pieces referring to it…

"It's a defense of fools", according to Fabrice Arfi, of Mediapart

“Beyond the legal quibbles, it shows that these recordings are embarrassing for him. Especially the one on the Russian contract, says Fabrice Arfi, co-manager of the Mediapart Investigations department. It is a defense of dupes… ”In fact, if Mediapart has always refused to reveal its methods, a scientific police report“ privileges ”the track of a“ recording by a dictaphone or a smartphone ”. A method far from being "professional", therefore ...

“Alexandre Benalla's approach is skillful, says a source familiar with the matter. As there will always be a doubt about the origin of the recordings, he rushes into the legal breach to request the cancellation. And if he succeeds, the investigators will also be able to erase from their tablets all the acts that were carried out from the recordings.

Contacted, the lawyers of Alexandre Benalla and Vincent Crase did not wish to answer our questions. On February 4, the decision of the investigating chamber should be reserved.
