17 July 2019The chief prosecutor of Agrigento, Luigi Patronaggio, the adjunct Salvatore Vella and the prosecutor Gloria Andreoli filed this morning, the last useful day, the appeal to the Court of Cassation against the failure to validate the arrest of Carola Rackete, the commander of Sea Watch 3, accused of resistance to public officials and "warship resistance and violence".

On June 29, Rackete forced the checkpoint of the Guardia di Finanza entering the port of Lampedusa, during the maneuver the Sea Watch hit the patrol boat of the Yellow Flames. According to prosecutors from Agrigento, the order of the investigating magistrate Alessandra Vella, which did not validate the arrest on 2 July, is incorrect from the point of view of the legal assessment. The prosecutor had asked for a ban on residence in the province of Agrigento.

Tomorrow, the thirty-one-year-old German interrogation is set in the context of the first investigation file opened: that for aiding illegal immigration and warship disobedience. Failure to appeal to the Review Court, which instead has the decision on the precautionary measure, determines that the Sea Watch commander will not face new restrictive measures.
