It was an announcement that had delighted users of public transport in Ile-de-France. Quite proud, Valérie Pécresse had indicated in a tweet, on January 8, having obtained "from SNCF and RATP the full reimbursement of a month of Navigo Pass for all Ile-de-France residents". Until the online platform for receiving reimbursement requests is set up, the question arises as to whether the user will have to share the (small) cake with his employer.

Indeed, recalls Charles-Emeric Le Roy, partner in the social department of the GMBA firm, “the employer is obliged to reimburse 50% of the ticket, Pass Navigo and others, as well as the public transport subscriptions which allow the employee to go to his place of work, like TGV or TER subscriptions ”. It is therefore entirely conceivable to think that for the reimbursed month, the employer claims from the employee 50% of the ticket, or 37.60 euros in the context of the Navigo Pass.

If he recognizes that "the case has never arisen", the expert confirms the possibility for the company to claim his share. Indeed, the latter does not have the right to reimburse if the employee does not provide proof of purchase of the Navigo Pass, this may be considered by Urssaf as disguised wages, since reimbursement is not subject to charges and contributions. By reasoning the opposite, one could estimate that the employer should not reimburse 50% of the Navigo Pass and therefore should recover the undue reimbursement.

However, Charles-Emeric Le Roy remains skeptical: “In practice, it will be complicated to do because the employer could not recover his due until the employee has proven and admitted that he has obtained reimbursement. And it is unlikely that the employees will jostle at the gate to prove that they have been reimbursed.

In addition to these practical difficulties, the GMBA partner puts forward a psychological pitfall: "The employees were hyper impacted by the strikes in December and asked them, while they took 2 hours in the morning and 2 hours in the evening to come to work, to return the 50% would be quite frowned upon.
