The Barcelona City Council has opened a sanction file of 90,000 euros to the Idealista real estate portal and to the New House Barcelona real estate agency for publishing as a requirement in a rental notice that the tenant should be Spanish.

In a statement on Saturday, the session has explained that it considers it a case of discrimination in access to housing because of origin, and that it is the first time that it opens a file for this reason.

The announcement was published in June, and a citizen communicated it to the Office for Non-Discrimination of the City Council, which has assessed that by demanding Spanish nationality to lease a flat "expressly excluded another group, non-Spanish people."

"The deprivation of an entire group, in this case to non-Spanish people, in access to a basic good such as housing is not protected by the right to freedom of contract, " said the session, which also stressed that the The right not to be discriminated against on the basis of origin is included in the Constitution.

The City Council is instructing a total of 134 disciplinary proceedings related to housing , for reasons such as permanent unemployment, real estate harassment or renting a property without authorization, and is also doing the preliminary proceedings in another 155 cases.
