The court found that the defendant hastened to accuse the plaintiff of harassing her without evidence, which is available to him in order to verify a form of abuse of the right to report crimes to the competent authorities, and that the defendant was damaged by the procedures he was subjected to causing psychological harm as a result of an act The defendant is with him.

The misdemeanor court had fined the accused 5,000 dirhams for assaulting the accused’s privacy, photographing and publishing his photos using the information technology means, where the victim filed a lawsuit before the total civil court demanding financial compensation for the damages incurred.

According to the prosecution’s indictment, the defendant assaulted the victim’s privacy, in other than authorized cases, took a picture and a scene of it, published it using the “WhatsApp” information technology, and sent it to another person, and demanded that the public prosecution punish it according to the Anti-IT Crime Law the average.

For his part, the victim reported that the accused had photographed him on her mobile phone while he was in a mall, on the pretext that he was harassing her, and pursued him until he reached the restaurant hall and even exited the mall.

He explained that the accused continued to photograph him until he reached the parking lots, where he denied during the investigations that he molested the suspect or approached him, pointing out that he published his picture through a recorded clip that was ridiculed by him through the "WhatsApp" program, and surveillance cameras revealed in the car parks of the mall, according to For investigations, the accused was holding her mobile phone and photographing and chasing the victim.

For its part, the defendant indicated in the civil lawsuit filed with the total civil court that the allegations made by the plaintiff did not prove any material damages incurred by him as a result of taking pictures of him, which he published on social media, and continued that the act attributed to her in the case papers relates to an incident Take a photo of the plaintiff, not a group of photos.

She clarified that she sent the image to the investigation officer, who was asked to photograph the plaintiff to identify his identity, and that she did not publish the plaintiff’s image through the means of information technology, pointing out that there is no basis for moral damage to the plaintiff, as it is only sent statements that do not bear any evidence of their authenticity.

She added that the plaintiff did not provide any benefit from the publication of his image through the means of information technology.
