19 December 2019For the granting of house arrest a "complete repentance" is necessary and the "civil repentance" must be deepened and verified over time. This is explained by the first criminal section of the Cassation in the reasons for the sentence with which, on 7 October last, it rejected the request for domiciliation to the collaborator of justice Giovanni Brusca, who is serving 30 years in prison in Rebibbia, with the end of the sentence in 2022, for the massacre of Capaci and other heinous crimes.

Dna and Dda of Palermo had expressed a favorable opinion, the operators recognized a critical review path, Brusca also already received 80 award permits: elements, together with his "very relevant collaborative contribution", positively evaluated by the Rome surveillance court , which however last March rejected the request - underlining that "it has not yet really traveled the path of the emendation towards the victims, of the moral redemption in regard to the family members" - finding the Supreme Court in agreement.

According to the Cassation, the surveillance court correctly deduced the lack of proof of "an effective complete repentance", a course "currently only undertaken". He made an interpretation in line with the jurisprudence where he maintains that "Brusca's effort in expressing his civil repentance and his intent to reconcile with the families of the victims and of society as a whole must be deepened and verified over time". And where he believes that "the seriousness of the crimes committed by Brusca and the criminal caliber which he has shown in his life to possess, lead to considering the certain and definitive proof of his repentance not yet acquired".
