The European Court of Justice ruled this Thursday, December 19 in favor of Airbnb. In an attempt to counter this formidable competitor, who represents 65,000 housing units in Paris, the association of French hoteliers, at the origin of the complaint, requires the intervention of the authorities.

Two years ago, the Association of French Hoteliers filed a complaint against Airbnb. According to her, the American site should obey the same rules as real estate agents: take out financial insurance and get a professional card. Constraints imposed by a law of 1970.

European justice has ruled hoteliers wrong. Airbnb does not have to comply with this law, and may even challenge it for procedural reasons. The French State has not informed the European Commission and Ireland, the country where the headquarters of the platform is installed.

" Major risk "

Airbnb is delighted with this decision. The hoteliers, them, deplore a “ blank check ” granted to the accommodation site. This " poses a major risk to players in the real economy, the only job creators, who bear the brunt of competition from platforms, " they denounce. The French State is ordered to rectify the situation so that European rules are everyone's business.

The Airbnb site is also in the crosshairs of the Paris town hall, which wants to regulate the rental of certain accommodation and the Umih, the main hotel federation, for unfair competition.
