The draft federal law “On activities in the field of collection of overdue debts of individuals” is published on the federal portal of draft regulatory legal acts.

According to the project, the collector will be able to apply to the court only after a 30-day period after receiving the notification by the debtor about the need to return the debt or in case of his written refusal to pay off the debt.

In addition, it is proposed to appoint managing organizations, homeowners' associations or housing cooperatives to be responsible for interaction with the debtor on the repayment of overdue debts in housing and communal services.

The bill also provides for the inclusion in the state registry of credit and microfinance organizations, pawnshops and other cooperatives involved in the recovery of overdue debts of individuals under loan agreements.

“The inclusion in the state register provides the relevant organizations with the authority to interact with debtors through personal meetings, telephone conversations, an automated intelligent agent (“ collector robot ”), as well as using text, voice and other messages transmitted over telecommunication networks to including mobile radiotelephone communications, ”follows from the document.

Other legal entities will be able to interact with debtors only by mail.

Earlier, the Ministry of Justice proposed expanding access of bailiffs to the credit histories of Russians in order to protect citizens from collector abuse.
