The treatment boards of the three Catalan prisons in which the nine independence prisoners are interned have proposed to classify them in second grade. This is what this classification implies:

What is the second grade? It is the denomination that the penitentiary norm gives to the situation in which the majority of the prisoners are in Spain . This is the "ordinary regime" of the convicted: You live and sleep in prison and allow access to ordinary exit permits. The second degree is opposed to the classification in the first degree (a strict regime reserved for dangerous or maladaptive prisoners) and the third degree (which means a life in semi-freedom). Does it allow you to leave prison? Yes. The second grade allows access to the so-called ordinary exit permits. They are limited to a total of 36 days a year distributed proportionally. Can you join several days in a row up to a maximum of seven? To enjoy them it is not only necessary to be in second grade. It is also necessary to have served the fourth part of the sentence imposed, a situation that none of the prisoners of the process has yet reached. The first to reach that quarter will be the Jordis, who has the lowest sentences and entered provisional prison before. On the other hand, Oriol Junqueras, with the highest sentence, should wait until January 2021. Is the decision final? The prison proposal must still be confirmed by the Penitentiary Serveis. They have a period of two months that can be extended up to four months, although it is most likely to be resolved in a shorter period. If the second degree is confirmed, the prisoners' lawyers can appeal the decision and request a more favorable situation, mainly the granting of the third degree. Will they serve the entire sentence like this? Prisons should periodically review the classification of inmates. That means that later the step to the semi-freedom regime of the third degree could be proposed. But most likely, the next step is to apply a variant of the second grade that allows, in practice, to give them some or many of the advantages of the third grade. This is the so-called 100.2 route, by the name of the article of the penitentiary regulation that regulates it. Appealing to a principle of "flexibility," Penitentiary Serves can authorize prisoners to leave several days of the week in prison. The concessions are not appraised, so it can be authorized from a departure of a few hours a week to daily departures or even the practical release. The judge can review that concession if the Prosecutor's Office resorts. But while the appeal is resolved, the inmate may benefit from the decision of Prisons.
