The real estate operation that allowed the Andalusian PSOE to open headquarters in the center of Malaga ended up costing the Andalusian Government 400,000 euros . That amount includes the 280,000 euros that the government that presided then Manuel Chaves paid for the building's premises that the PSOE delivered to the builder who did the work to pay the bill and that he immediately sold to the Public Land Company (EPSA ). The rest, the 120,000 euros added, is what the public entity spent on setting up the commercial premises when it was not even theirs. In the Land Registry, it still belonged to the Spanish Socialist Workers Party.

According to the official documentation to which EL MUNDO de Andalucía has had access, EPSA not only kept the number 4 bass of Ollerías Street - with which the PSOE paid off the debt of its work - but also paid its conditioning when it was not even yours, when in the Land Registry the premises were in the name of political formation.

The purchase and sale operation by which the Junta de Andalucía took ownership of that premises was formalized on May 10, 2006, date on which the Andalusian public company acquires it from the construction company Grupo Ruiz Jurado SA, in turn by the PSOE to remodel the building to house the grouping of the center of the Malaga capital. In payment, precisely, Ruiz Jurado - a businessman close to the PSOE - received the premises and the attic.

But although the real estate operation was not effective until 2006, the Chaves government spent two years before about 120,000 euros in works in that place, which it had irregularly. Those works were undertaken from the month of June and then he had not even signed the private contract that he signed months later with Ruiz Jurado, who had not even registered in the Property Registry the place in his name, with what was officially property of the PSOE. In fact, it was not until April 24, 2006 when the payment date is formalized and Ruiz Jurado becomes, for all purposes, the owner.

EPSA, despite all the above, acted as if the premises were his already in 2004 and months and when there was not a single paper that accredited neither the sale nor his property (the private contract was signed at the end of the year).

But this is not the only irregularity in the three-way real estate operation that settled the debt of the PSOE with the construction company that did the work of its headquarters.

In the same procedure by which EPSA contracted the work of conditioning the premises, the Public Sector Contract Law was breached, since they divided the works to be able to award them by finger, as indicated by the internal audit carried out by the Public Company itself Andalusian soil in November 2004.

In that audit, held by EL MUNDO de Andalucía, many other irregularities are pointed out, most of them related to the purchase and sale operation and how it was also done in violation of the legislation on contracts that governs public administrations and that prohibits, with very few exceptions appraised, verbal contracts like the one that EPSA arrived with Ruiz Jurado.

Moreover, says the Board's internal report, EPSA took possession of the premises and began the works without having any document, neither public nor private, that would legitimize it for this and when the ground floor of Ollerías de Málaga street was still of the PSOE .

Without meeting your own requirements

To this we must add that the public company skipped its own criteria in the search for the premises that were to house, and housed, the office for the rehabilitation of the historic center of Malaga. For example, EPSA was looking for a place larger than that of the socialist building and there was never any record of the burdens that weighed on it, that its use was linked to host the PSOE. In the purchase proposal signed by the then provincial EPSA manager, the detail that the property was owned by that party was omitted.

As if that were not enough, the company declared, for the purposes of the building license , a cost of renovating the premises much lower than the real one, which hit much less than it owed.

And all this was known by the Junta de Andalucía, since all these irregularities were reflected in the audit commissioned by EPSA itself and which was carried out at the end of 2004.

For all this, the Minister of Development, Marifrán Carazo, already announced last November that the legal services of the Board are analyzing the file of the operation to study possible responsibilities and, where appropriate, bring the matter to justice.
