The head judge of the Court of Instruction No. 1 of Eibar has issued the order to open an oral trial against the footballers Sergi Enrich, Antonio Luna and Eddy Silvestre . They are accused of violating the right of privacy of the woman who appeared in the video that was disseminated through social networks, in which he had sex with the first two defendants. Both the Prosecutor's Office and the private prosecution ask for five years in jail for both of them, for the recording and dissemination of the video. For Silvestre, who allegedly also disseminated it, the Prosecutor's Office asks for two years in prison and the private prosecution three.

This case dates back to October 2016, when said video was broadcast through WhatsApp . In it, Enrich and Luna had sex with a woman. At one point in the video, recorded in May 2016, the woman clearly demands ("stop, not that") the players who do not record the scene (Luna was doing it) with her mobile phone. The two players published a statement on their Twitter accounts asking for forgiveness for this fact. Hours later, the woman denounced the facts at an Ertzaintza police station.

Subsequently, an audio was also leaked in which Enrich accused Silvestre of being responsible for the mass diffusion of the video. At that time, the three players belonged to the Eibar Sports Society. Currently, only Enrich remains in the Gipuzkoan club , while Luna plays in Rayo Vallecano and Silvestre in Albacete, both in Second Division.

The defenses of the three defendants now have 10 days to submit allegations to the order to open an oral trial. Subsequently, the case will be transferred to a criminal court in San Sebastián, although the beginning of the trial could take several months. In the case of Enrich and Luna, the penalty requested is the maximum included in the Criminal Code in crimes against the right to privacy.
