The Anticorruption Prosecutor's Office has asked the court of Seville that it is investigating the ERE case that it cites to declare as former investigators - before the accused - the former president of the Junta de Andalucía Manuel Chaves and the former Andalusian counselor Gaspar Zarrías . He has seen signs of prevarication and embezzlement in the loan of 5,829,817.41 euros granted in 1999 by the Andalusian Government to the meat company of Jaén Campocarne Andalucía, before Children of Andrés Molina . Now, Anticorrupción has asked the investigating judge to open a new independent piece, which derives from the macrocause of corruption of the ERE, and calls to declare as investigated ten former Andalusian senior officials - in addition to Chaves and Zarrías, former advisers Guillermo Gutiérrez , José Antonio Viera, Antonio Fernández and Francisco Vallejo - and five managers of the Jiennense company benefited by the Board.

The prosecutor explains that the alleged embezzlement by the "bridge loan", granted by the Board on November 9, 1999, would not be prescribed because the credit "is consumed" when it is no longer considered an asset and becomes a loss, and he does not know when it happened, since the period of lack went from 2002 to 2008. The crime of embezzlement expires at 15 years. After the approval by the Governing Council, on December 2, 1999, just 20 years ago, the then Presidency advisor, Gaspar Zarrías, signed a "commitment" with the head of the company to channel the loan.

"It could be deduced that under the formal umbrella of a loan it was really decided to arbitrarily dispose of public funds without subject to any procedure or control to directly benefit the Campocarne company, which could initially be described as a crime of prevarication in a medial contest with crime of embezzlement, "prosecutors Juan Enrique Egocheaga and Manuel Fernández Guerra warn.

In fact, "the loan was never willing to be collected," as follows from the documentation analyzed by prosecutors. Anticorrupción considers that of the total of 5.8 million granted, 3.7 million were not returned by the company to the Board and form the alleged embezzlement of public funds denounced before the court.

In addition to the subpoenas of the 15 investigated, the Prosecutor's Office has asked the court to request various documentation on this loan from the IDEA Agency, the Presidency Department, the Employment Department and the General Intervention.

Convention disappeared

Meanwhile, the Andalusian Government will approve this Tuesday to bring to justice the disappearance of the files of the Government Council of a "key" agreement on the aid granted in 1999 to the former company Hijos de Andrés Molina, for which the Prosecutor's Office asks to impute Chaves and Zarrías.

This twenty-year agreement, which did go to the Governing Council, was requested in the previous proceedings of the ERE and during the trial, but the Board insisted that it did not exist . In January of this year, after the regional elections, the director of the Institute for the Promotion of Andalusia (IFA) said he had appeared and sent him to court.

The current Government of PP and Cs has verified that this matter appears on the agenda of the Governing Council of December 2, 1999, but the document is not in the minutes of that meeting. Moreno has admitted that they were very surprised that "someone" was "hiding for years" a document that now "implies" Chaves and Zarrías, since the Board said "it did not exist."
