by Tiziana Di Giovannandrea 30 June 2019The report of the Commission of the Ministry of Infrastructure and Transport on the possible revocation of the concessions to Autostrade, following the collapse of the Ponte Morandi, speaks of a serious breach that would allow the unilateral revocation of the concession to Aspi, the company Autostrade per l'Italia.

From what has been leaked through the press on the document, developed by the MIT Technical Commission, it would be argued that the collapse of the Ponte Morandi resulted in the failure to return an asset that, due to the concession, had been entrusted to Aspi, which was therefore required to return it intact. For this reason, according to MIT technicians, there is a serious breach that opens the way for the unilateral revocation of the concession.

According to the working group, "the collapse suggests serious gaps in the maintenance system that can be considered to exist on the entire motorway network and therefore justify the State having lost confidence in the work of Aspi". It should however be borne in mind that the Autostrade company has already begun a strong extraordinary maintenance intervention after the collapse of the Ponte Morandi.

Furthermore, according to the report, some clauses of the agreement that provide compensation for early termination are void, even if it is not excluded that Aspi will open a dispute.

The State, this State, is with you ". So Luigi Di Maio commented on Facebook what was leaked on the report of the MIT work group.

Government M5S sources: no compensation in the event of revocation
No compensation or compensation is due to Autostrade per l'Italia if the concession is revoked due to default. Article 9 bis of the convention establishes that the right to compensation or compensation of the concessionaire exists 'in compliance with the principle of custody'. This is what the government's M5S sources say.
