Contracts by finger, awards without advertising, by way of urgency and without justification, invoices paid without contractual coverage ... The municipal government of Cádiz presided by José María González, Kichi , has incurred in almost every conceivable way to circumvent controls and hire services outside the law, as evidenced by the report of the Chamber of Accounts of Andalusia that was known yesterday and that gives a monumental ear to the Cadiz City Council that controls Podemos.

The audit report focuses on the 2017 awards of the local government of Cadiz and the conclusion cannot be more devastating. The Kichi government team skipped the contract regulations, specifically the Public Sector Contract Law, when granting much of the Consistory awards that year.

One of the irregularities that the Chamber of Accounts draws most attention to in its report is the use of the minor contract , a figure contemplated in the legislation but as a procedure “of an exceptional nature” and with the sole and exclusive purpose of satisfying, says the inspection body, "in a simple and agile way needs of small amount and duration".

The Chamber of Accounts analyzed a sample of the 425 files of minor contracts signed by the City of Cádiz in 2017, 86 files for an amount of 364,000 euros compared to more than 930,000 of the total.

Of all the hiring files signed that year, 81% used this formula.

Split Contracts

But there are more irregularities. In three of the contracts examined, the auditors detected the fractionation of the contract, another trick that makes it possible to avoid the publicity and concurrence requirements that, by law, should prevail in these procedures. In addition, in two of the cases they are approved after the conclusion of those contracts and, as if that were not enough, in one of the files, the signing of the contract is subsequent to the performance of which the contract was subject. That is, it was first executed and then the contract was made, "completely disregarding the established procedure", underlines the report of the Chamber of Accounts.

With regard to non-minor contracts -98 concluded in 2017 for an amount of 13.4 million-, most of them, 56% follow the negotiated procedure, another formula that in theory can only be used exceptionally. In none of the files analyzed, the auditors say, was this procedure justified.

Also, and among the triquiñuelas found, the municipal government of Podemos in Cádiz abused the emergency processing.

However, the most striking aspect of the auditors' findings is how during the whole of 2017 the Cadiz Consistory paid nearly one million euros in bills for the conservation, maintenance and modification of public lighting without any contract with the company that took care of it. The award had expired in 2016 and was not renewed until June 2018.
