The Prosecutor's Office of Barcelona will present an appeal to be convicted of sexual assault, and not abuse, of the perpetrators of the multiple rape of a child under 14 in a ship in Manresa.

The Public Ministry has announced on Wednesday its intention to appeal the judgment of the 22nd section of the Audience of Barcelona, ​​which last Thursday sentenced to sentences of 10 to 12 years in jail for a crime of sexual abuse to five of the six defendants for the multiple violation, occurred in October 2016.

The convicted are on probation and, in fact, only one of them remained in preventive detention for two years because of the open cause of the multiple rape.

The Barcelona Hearing condemned the five defendants against the Prosecutor's criteria, which although at the beginning of the trial accused them of sexual abuse, in their final conclusions they asked that they be convicted of sexual assault, on the understanding that they intimidated the victim, using its numerical superiority and the state of drunkenness of the child.

In his sentence, the court expressed his "surprise" at the change of opinion of the Public Prosecutor in the final conclusions of the trial.

In the opinion of the court, when the victim was raped, she was "in a state of unconsciousness, without knowing what she was doing and what she was not doing", which in her opinion fits in article 181.2 of the Criminal Code, which considers non-consensual sexual abuse (. ..) those who run on people who are deprived of meaning "or by canceling the will of the victim through drugs, drugs or other substances.

The sentence acquitted one of those accused of the multiple rape, because during the investigation of the case he was not prosecuted for the crimes of abuse or sexual assault, and a seventh man who allegedly masturbated while witnessing the attack and who was being accused a crime of omission of relief.

The court concludes that that seventh defendant could not have done anything effective to prevent crimes committed by a plurality of men and in a field far from inhabited areas where they could find help, outside to stop the attacks on the victim or, in case of face only the attackers, avoid the possible aggressive reaction of these against him. "
